36
Single European Sky
  • The Single European Sky Regulations promotes and
    mandates the use of-
  • generic harmonisation/standardisation processes
    for products/services
  • generic conformity assessment procedures for
    products in ATM
  • They have the potential to modify significantly
the way ATM safety regulation (inc. oversight) is
    conducted today

37
Topics
  • Global and New Approach
  • SES Draft Interoperability regulation
  • Implementation of New/Global approach
  • Proposal for a joint RU/SRU Task Force
  • RC and SPG views
  • Way Forward
  • Recommendation to SRC

38
Global and New Approach
39
Technical Harmonisation and Standardisation (1)
  • Directives 98/34/EC of the European Parliament
and of the Council (June 98) amended by Directive
    98/48/EC lays down
  • A procedure for the provision of information in
the field of technical standards and regulations
and of rules on Information Society services
  • in order to promote the smooth functioning of
the internal market. (so called New Approach)

40
Technical Harmonisation and Standardisation (2)
  • The Directives apply to-
  • any industrially manufactured product, and
    applicable technical regulations
    specifications
  • any service normally provided for remuneration,
at a distance, by electronic means and at the
individual request of a recipient of services,
    and applicable rule.
  • The Directive aims at ensuring maximum
harmonisation of rules standards at European
    level.

41
Conformity Assessment (1)
  • Council Decision 93/465/EEC (July 93) concerns
  • modules for the various phases of the conformity
assessment procedures and the rules for the
affixing and use of the CE conformity marking,
which are intended to be used in the technical
    harmonization directives
  • for the assessment of conformity of products to
ensure they are in conformity with Essential
    Requirements

42
Conformity Assessment (2)
  • The Council Decision applies to-
  • products placed on the market
  • The Decision aims at ensuring their conformity to
the requirements expressed in the provisions of
    the Essential Requirements/Directives, in
particular with regard to the health and safety
    of users and consumers.
  • Conformity assessment is organised into modules.

43
(No Transcript)
44
Conformity Assessment (3)
  • Essential requirements (directive or regulation)
  • must specify a conformity assessment procedure,
which is to be applied by the manufacturer before
the product may be put on the market, and this is
materialised by a CE marking (however some
directives and regulations do not require a CE
marking, and this is the case of Draft SES
    Regulation 2001/237).
  • If some third party assessment required
  • Conducted by Notified Bodies that have been
    designated by Member States
  • Directive/Regulation must also define the
    requirements applicable to such bodies.

45
SES Draft Interoperability Regulation
  • Implementation of New/Global approach

46
SES Rule Making hierarchy
Common Essential Requirements (Mandatory)
Implementing Rules (Mandatory)
Community Specifications (Voluntary Standards)
47
SES Supervision framework (1)
  • Certification of ANSPs against Common
    requirements
  • Based on surveys and inspections (subsidiarity
    principle)
  • Verification of compliance
  • Compliance Verification processes anticipated for
constituents and systems, nothing for procedures
    etc..
  • Implementing Rule should contain the type of
compliance verification mechanism (and what is
    potentially required of Notified bodies)

48
SES Supervision framework (2)
  • Presumption of conformity with ER/IR
  • if manufacturer issues an EC declaration of
conformity or suitability for use of
    constituents
  • if compliance of constituent with Community
    Specifications
  • ANSP issues a EC declaration of verification of
    systems with technical file
  • Notified bodies, third party empowered to carry
out verification tasks and to issue certificate
    of compliance based on outcome

52
Proposal for a joint RU/SRU Task Force
  • Focus on Conformity Assessment in ATM/CNS

53
RU/SRU Initiative
  • Harmonised application of conformity assessment
    is instrumental for SES
  • EUROCONTROL, Safety regulators, ANSPs have
accumulated experience in the field of
verification and approval of ATM systems

    assessment need to be defined
  • Creation of a Task Force to address conformity
    assessment

54
Objectives of the Task Force

concepts across the EC SES regulatory package
    proposals
  • Existing regulatory approval approaches in
aviation and more specifically in ATM.

55
Objectives of the Task Force
  • To assess the suitability of existing modules as
defined by Decision 93/465 for conformity
assessment of ATM systems/procedures and define
    additional modules as required
  • To develop principles for a harmonised
    implementation of standardisation procedures and
    ATM conformity assessment processes
  • To develop principles for the harmonised
    definition of conformity assessment requirements,
to be described within each SES implementing
    rule.

Agenda Item 8 - ESARR Issues

100
Agenda Item 8 - ESARR Issues
8.1 ESARR 1 - Status
101
Agenda Item 8 - ESARR Issues
8.2 ESARR Transposition - ESARR 2 Mapping
102
WP 18.03 Attachment
103
Approach
  • Technical assessment
  • ESARR2 Ed 2.0 and EC94/56 and 42/2003 Directives
  • Description of the ESARR content and ESARR 2
requirements retained to ease EC assessment of
    the report

104
Main Conclusions (1)
  • There is a certain amount of overlapping in a
    number of areas
  • There are no contradictory requirements or
statements between ESARR 2 and EC Directives
    2003/42 and 1994/56
  • EC Directive 2003/42 is limited to reporting. The
requirement to investigate safety occurrences is
    not evident in this Directive

105
Main Conclusions (2)
  • 94/56 is limited to the investigation of
    accidents and serious incidents
  • Geographical coverage is wider for ESARR 2
  • EC Directives have no clear applicability to
military stakeholders like in ESARR 2

106
Main Conclusions (3)
  • Main drawback are the missing parts from ESARR2
  • Contextual data to be collected and stored
    (Appendix A - section A2)
  • Results of the assessment/investigations to be
    stored (Appendix A section A3)
  • Minimum content of the summary reports to be
    exchanged (Appendix B)

107
Main Conclusions (4)
  • Main sub-requirements from ESARR 2 missing
  • 5.1.5. (expertise of the investigation team,
timing of the investigation process and of
    remedial actions)
  • 5.1.6 (determination of the severity and risk)
  • 5.1.7 (analysis of the causes)
  • 5.1.8 (development and oversight of the safety
    recommendations, intervention and corrective
    actions implementation)

108
Main Conclusions (5)
  • The Directives lack of DEFINTIONS/TAXONOMY
  • Technical Incidents might be excluded from
exchange of information (phase 3 of ESARR 2)
  • Door open for safety benchmarking

109
FINALLY
  • ALL states that have implemented ESARR 2
considering a mandatory reporting scheme ARE
compliant with the 2003/42 Directive (ATM part).

110
Recommendations
  • SRC is invited to
  • a) agree the formally submission of the SRU
    report to the EC
  • b) agree to put the SRU report in SRC formal
consultation process, in order to become an ESARR
Advisory Material for ESARR 2 (EAM2)
