  • OSHA is empowered to issue a TES as an interim
    measure until a permanent standard can be
    developed.

TEMPORARY VARIANCE
  • If employer is not able to comply with a new
    standard by its enforcement date, employers may
    file for a TEMPORARY VARIANCE
  • Temporary variance can be granted up to a maximum

PERMANENT VARIANCE
