political maneuvering taking place on Capitol
Hill of concern to CUPA-HR members. This
online, password protected report is made
available to CUPA-HR members around the first of
each month. It can be only accessed through the

  • Congressional Committees Address Two Topics of
    Importance to HE HR Professionals The H-1B visa
    program has drawn some attention over the last
    several months as the cap on the number of H-1B
    visas available (65,000) for FY05 will soon be
    reached. Over the last several months, some
    members of the Senate Judiciary Committee have
    been discussing potential H-1B visa amendment
    language to an immigration bill. It currently
    does not appear that the bill will pass this
    year, though that situation could change.

  • Pension Deferrals for 403(b) and 457 Plans
    Expanded, 403(b) Plan Assets May be Subject to
    Bankruptcy Court Control ... The Sixth Circuits
    decision in Rhiel v. Adams , 302 B.R. 535 (6th
    Cir. 2003), has taken the benefits community and
    403(b) participants by surprise. Previously,
    participants who had built up retirement savings
    in 403(b) plans believed that those monies were
    exempt from their bankruptcy estates. Section
    541(c)(2) of the Bankruptcy Code provides that a
    debtors beneficial interest in a trust that
    restricts transfers and is enforceable under
    non-bankruptcy law will not become part of the
    bankruptcy estate. The Rhiel court, after
    examining the 403(b) plans in question and the
    underlying contracts, found...

  • The association's government relations
    consultant, located in Washington, DC, attends
    key government meetings, press conferences at
    U.S. offices, and works in conjunction with other
    higher education and human resource lobby
    coalitions to push its agenda. With CUPA-HR
    leaders' direction, the consultant prepares and
    represents CUPA-HR's support on worthwhile
