In Alberta, you should typically be at least 18
years old. There are some limited exceptions to
this. In other jurisdictions, the minimum age for
writing a will may be some other age, such as 19
or 21.

Does a new will revoke pre-existing wills?

  • Usually, a new will revokes pre-existing wills.
    Typical wording is something like I hereby
    revoke all former wills and codicils. In some
    cases, a person is simply amending a pre-existing
    will with a short document.

This is known as a codicil. In some jurisdictions
such as Ontario, it is somewhat common to have
two wills one will for assets to be probated
and one will for assets that wont be probated.

A codicil is a document that amends an existing
will. Codicils are somewhat rare these days.
Before the use of computers in law offices, the
preparation of a will was a labor-intensive task.

It would cost a lot in terms of time and money to
do a new will simply to change the name of an
executor or to change a minor gift within the
will. Codicils were designed for these purposes.

Today, a lawyer usually saves a draft of your
will that can be easily modified at a later date.
For this reason, codicils are rarely used today.
