3The FAA Procurement System The Preference For
ADR
- 2003 Vision 100--Century of Aviation
- Reauthorization Act (Public Law 108-176),
- Congress directed the ODRA to
- use consensual ADR techniques to the
maximum extent practicable, and to only use
adjudication for a bid protest or contract
dispute that is not addressed or resolved in
ADR.
4Preference For ADR (Contd.)
- Under 49 U.S.C. 40110 (d), all bid protests and
contract disputes that cannot be resolved through
voluntary ADR shall be adjudicated by the
Administrator through dispute resolution officers
or special masters of the Federal Aviation
Administration Office of Dispute Resolution for
Acquisition.

- Get a clear understanding of the solicitation
requirement and terms before you submit a
proposal - Ask for a debriefing if you dont win the
contract award - Whenever possible, attempt to resolve issues with
the CO before filing at the ODRA - Start with the ODRAs pre-dispute process if
possible - Know the ODRA Timeliness Rules (published on the
website and at 14 C.F.R. Part 17)
