  • You can see a lawyer walking out of the courtroom
    beaming with success, but in reality very few
    clients have enough knowledge or training about
    how to evaluate the lawyers performance in a
    trial, document, or transaction. The most common
    requirements clients put forward prior to hiring
    a lawyer is they should be experienced,
    niche, a specialist, etc. Mastering a
    specific field or industry is surely one of the
    biggest influencers for lawyers in winning a
    case, but there are some other factors involved
    too. Lets examine some of the core traits or
    aspects a trial lawyer needs to acquire in order
    to rule any courtroom or case with flying colors.

Credibility
  • At the initial level comes the credibility,
    which serves as the foundation of trust-building.
    Any effective and solid representation requires
    building a high level trust with your client,
    jurors, judges, and even the opposing lawyer or
    parties. Although keep in mind this trait cannot
    be taught, but should be earned with your
    dealings!

  • For instance, when a credible lawyer promises his
    client that he will be available on a certain day
    for discussion on legal requirements, that client
    will surely believe. Similarly, when that
    attorney makes a promise with the judge or
    opposing counsel regarding presenting an
    evidence, then that promise is kept into account.
    Simply put, if you make a promise or commitment,
    then act for it without any exceptions.
  • The time and cost taken to undo some commitments
    regardless of the reason is undesirable and a
    time-consuming frustration. It also lifts the
    trust off the attorney in the eyes of everyone
    involved in the case, no matter how much
    experienced that attorney is in the field. In
    short, a credible lawyer understands the fact
    that every interaction presents a chance of
    either building a trust or destroying it.

Civility
  • Litigation is an argument in dispute resolving if
    seen from the root. Its quite easy to turn the
    argument into a heated one, but the case is not
    preferred in a court system. An argument can flow
    politely too rather than being confrontational.
    Effective lawyers understand the fact that in the
    act of persuading your point, civility could be a
    very powerful tool used.

  • Using aggressive tactics such as raising volume,
    hostility in tone, or anger may win you some
    benefits for the short time being, but the gains
    will be short-lived and your ability will be
    greatly undervalued in the long-term game of
    persuasion. Such aggressiveness tends to move the
    discussion away from key witnesses and points,
    and rather focuses more on emotional aspects
    which are difficult to control. Also when it
    comes to compromising or drafting out the best
    solution for both parties, the uncivil manner
    earlier seen will make it difficult for you to
    work with the opposing party in peace. The choice
    of such behavior depends on specific situations,
    but successful and powerful trial lawyers tends
    to fight for their clients restlessly keeping the
    intelligence, respect and grace factors intact.
