SPECIFIC NOTES FOR STUDY PERMIT PERMIT REFUSAL
2017
  • What it takes to choose a right course for you to
    study?

2
  • Although, Canada is very attractive to the
international students as recently announced last
December of 2016, that earning a qualification in
Canada would earn an additional points to your
    Comprehensive Ranking System (CPRS) e.g.
obtaining two ( 2) year studies for diploma or
certificate course equates to 15 points and
earning master or bachelor degree gives an
equivalent of 30 points. In addition to this they
may also get a Post-Graduation Work Permit -
depending on the duration of the course intended
to undertake by a student, not to mention when
getting a work permit may still renew as work
permit rule for four (4) cumulative rule has been
removed, which may lead to your permanent
resident application if you are eligible to
apply. But what really confusing for others is
how they going to get their study permit
approval, regardless if they do it by yourself or
with an agent. Let us share you some helpful
information for you to weigh in all the relevant
information and documents you may have in case
you already prepared your application and is
about to submit to the visa office taking into
    consideration the specific visa instructions,
it is imperative to note that anywhere you are in
any part of the world you can submit youre study
permit application, either online or via paper
based application, for as long as you have a
valid work permit or visa at the time you
submitted youre application to study in Canada.
The criteria and eligibility assessment are the
same, except it only differ with a specific visa
instructions of which county you are supposed to
    submit your study permit application.

3
  • A client from India has contacted us regarding
his previous refusal of study permit in Canada,
he intends to study in a certain university in
Canada, upon learning his refusal regarding
other seasons your proposed studies are not
reasonable in light of one or more of your
    qualifications, previous studies, missing mark
sheets, academic record, level of establishment,
language abilities, or your future prospects and
plans. This would have been quite difficult to
understand if someone has not gone in dealing
with several applications which fall on the same
grounds of refusal in their study permit. It is
true enough, anyone can apply and do it by
yourself (DIY ) or represent by an agent - but
this doesnt guarantee a 100 approval as the
visa office will look into the information and
documentary evidence submitted by the client.

4
  • He had no issues financially as it looks like he
is capable to covering tuition fee cost, travel
cost and living cost in Canada and any other
expenses which may incur during his propose
studies to Canada, but he may have a little
issues about his motivation to study in Canada
noting that his education history shows a low
grade point average, and unable to demonstrate a
logical progression of his course as to why he
choose to study that course in the university,
given the course he has done in the past.
Further to this, though he has an IELTS total
score of 6.5, he has 5.5 in writing, which the
visa officer concluded, that it would have been
difficult for a student to study in Canada noting
the language use to study in Canada is English
and French in some region. From our point of
view, the student have taken the IELTS and has
been assessed for admission to the university
with the IELTS score he has had and has been
admitted by the university, is it really one of
the basis of having low IELTS score of 5.5 in
writing as one of the criteria for determining
and assessing the application to the context of
bonafide student? WE also note, that in the study
permit University student visa instructions for
(May 2016) excerpt Test result taken within the
last 24 months to demonstrate ability in the
language of proposed study- again, there is no
clear score indicated therein as to demonstrate
meeting the required score on IELTS.

5
  • WE understand the specific visa instructions for
    University students and Student Partners
Program (SPP), IELTS for SPP a total band score
of 6.0 and no lower than 5.5 in other areas
category policy and General category when
submitting the application, as it posted at the
embassy website, however, we believe in our
opinion, it may be correct to address certain
low average academic score of qualification,
study course progression among others but, to
give and include to emphasize of having an
IELTS of 5.5 in writing is not reasonable to
identify and concluded that the student is not
bonafide, common, most international students who
are studying abroad in an English speaking
environment would likely to improve their skills
from listening, speaking and writing - it
should not be in part of the low score in
writing basis that the student may not complete
the course and that he is not a genuine student!
While, there is no clear statement of the
regulations for this category of study permit -
stating that the international students should
have a higher score on IELTS, in particular
with the writing skills, for them to be able
to qualify to apply for a study permit.

6
  • Choosing for a course to study in Canada would
have an impact to your study permit application
and therefore, when contemplating to study in
Canada, choose a right course for you, depending
    on your existing qualification, skills,
experience and interest, it is best to consider
that it must be related, (and the progression of
the course is credible enough) but not to the
point entirely that it is almost similar as it
will attract a possible refusal in the end.
  • Moreover, with the changes in place last July of
2016 from IRCC, which they can no longer issue a
study permit duration entirely, if the
international students will be studying the
combine courses e.g. English studies, bundle
with diploma or certificate courses. In other
words, an applicant may only get one (1) study
permit entailing the duration of his 1st course,
assuming he has been granted a study permit, and
s(he) will need to renew his study permit there
in Canada, once the 1st course has been
completed, to continue with another bundle
course. As we reiterate, they will no longer
issue the total duration of your study permit in
case you choose to study in combine courses, as
the visa office raised concerns, that student may
not guarantee the completion of studies.
