thus, not every divorce is the same. An

York City clients reach equitable settlements.
  • Since founding the firm in 1982, Barrocas, Mintz,
Misuraca and Record Family Law Mediation has
utilized collaborative law, mediation or direct
negotiations to settle most of our cases.
  • Our lawyers have been through extensive mediation
training at the Center for Mediation in Law in
New York. We serve as neutral mediators to
    facilitate an equitable divorce settlement
    between you and your spouse.

9
PRENUPTAL AGREEMENT
  • A prenuptial agreement is a legal agreement
between two people who are planning to get
married. This agreement defines how property and
assets will be owned and managed during the
marriage, and how they will be divided if the
    marriage dissolves.

10
PRENUP AGREEMENT LONG ISLAND
  • Prenuptial agreements on Long Island are becoming
increasingly more common. Couples are marrying
later in life, or are entering second marriages,
and with this comes more family and potentially
more wealth/assets, and concern about ones
financial future. The team of Barrocas, Mintz,
Misuraca, and Record Family Law Mediation have
expertise in helping couples negotiate fair and
valid agreements that establish property and
financial issues at the start of a marriage,

11
PRENUP AGREEMENT NYC
  • Prenuptial agreements are created to
  • Detail the division of property in the event of
    divorce
  • Provide for children from a previous marriage
  • Preserve assets brought into the marriage
  • Protect business interests
  • Keep individual debts separate
  • Outline what will be marital property and what
    will remain separate property
  • Determine management of household finances in
    advance

12
REACHING AGREEMENT THROUGH MEDIATION
  • Divorce mediation is becoming an increasingly
popular alternative to a traditional divorce. The
way mediation works is that a trained neutral
party facilitates and aids the spouses or
domestic partners in coming to their own
agreement, which settles the issues in their
    divorce, including
  • Physical custodychild custody, co-parenting and
parenting scheduleswhere will the children live,
with whom do they spend holidays
  • Legal custodyhow are major life decisions made?
    For example, religion, dental/orthodontia,
    college
  • Child Support and Expenseshow are the childrens
expenses going to be paid, such as college
tuition, health and dental insurance/bills, camp,
and other extracurricular activities? Will a
    parent pay child support?
  • Spousal maintenancehow will spousal maintenance
    be handled?
  • Distribution of assetswhat will happen to the
home and its contents, other homes, vehicles,
savings and retirement accounts, credit card debt?

  • When you hire an experienced, trained mediator
who is also an experienced family law attorney,
you will gain the critical information of your
rights under the law. You will also get the
perspective of what a judge would likely do with
the facts presented during the mediation
    negotiations.
  • Additionally, an attorney/mediator is qualified
to create the Marital Settlement Agreement
memorializing the parties agreement if the case
settles. At Barrocas, Mintz, Misuraca and Record
Family Law Mediation, we  will facilitate the
negotiation process between you and your spouse
and guide you to reach the best possible outcome
    for your case.

14
Divorce mediation NYC
  • The State of New York has adopted No-Fault
Divorce, whereby New York couples can request a
divorce by claiming that theres been an
irretrievable breakdown in their marriage or
domestic partnership, which means they do not get
along anymore, and there is no chance for a
    reconciliation.
  • A New York couple may get a no-fault divorce on
    any of the following grounds
  • the marriage/domestic partnership has broken down
irretrievably for at least six months.
  • living apart for a period of one or more years,
after a judgment of separation or
  • living apart for a period of one or more years
    pursuant to a separation agreement.
  • Before a court will grant a no-fault divorce, the
couple needs to show and prove that their
    property division, spousal support, child
support, and child custody have all been
resolved. This can be done between the spouses in
a divorce settlement agreement or by a court
    order.

Benefits of Mediation
  • There are many benefits to the process of
    mediation, including
  • Reduced costs In most cases, mediation costs
    less than litigation.
  • Expedited process With an over burdened court
system, you are more likely to finalize your
divorce sooner through mediation than waiting for
a court to decide motions and ultimately hold a
    trial.
  • Limits stress Working with a mediator is a more
relaxed environment and more conducive to
collaboration, and is overall less intimidating
    than a courtroom.
  • More empowering Spouses resolve their own
disputes, rather than being handed a decision
from the judge. Mediation addresses topics such
as parenting plans and co-habitation, which the
    courts do not.
  • Fosters cooperation Parents begin the process of
cooperation, which is critical to raising
    well-adjusted, happy children after divorce.

Maintenance Spousal Support
  • In New York spousal support, or maintenance, is
defined as the payment of money from one spouse
to another under a court order or written
agreement for living expenses.  The goal of
maintenance is to provide support while the
recipient spouse gains the necessary skills and
    employment to be self-sufficient.  Our
    experienced attorneys at Barrocas, Mintz,
Misuraca and Record Family Law Mediation will
help you understand your rights and guide you on
how spousal support may be awarded given your
    situation.
