  • The truth about federal income tax is hidden in
    the wording of the statutes themselves. As I said
    in my last newsletter, the Congress could have
    made the tax code clear by stating that all
    Americans are required to pay tax on everything
    they earn.
  • Nothing like that exists in the tax code. In
    fact, the tax code is filled with a bunch of
    lawyer jibberish designed to confuse and
    frustrate. All 75 Million words of it!
  • Now lets pick up where I left off in my last
    newsletter
  • The term includes in a statute cannot be used
    to expand and thus change its meaning.

  • When a term is followed by specific identifying
    words it must be understood to limit the term to
    that which is being specifically identified.
    It is a commonplace of statutory construction
    that the specific governs the general Morales
    v. TWA, 504 US 374, 384 (1992) (emphasis added)
  • In other words, the term employee in section
    3401 means only the federal employees listed
    therein and nothing else. Likewise the term
    trade or business is restricted in meaning to
    only the performance of the functions of a
    public office.
  • The same rule applies to the entire the tax code.
    Congress wrote the code and the courts interpret
    it.

  • Now, on to the terms include and including as
    defined in the federal tax code. In 26 U.S.C.
    7701 (c) Includes and including The terms
    includes and including when used in a
    definition contained in this title shall not be
    deemed to exclude other things otherwise within
    the meaning of the term defined.
  • What all this means is that section 3402s
    definition of wages references money paid to
    employees does not include within its scope
    any free market employee working in the 50
    States. Like Ive been saying all along, if that
    is what Congress intended the statutes to say
    they would have written them that way.

  • So anyone who does not fall within the definition
    of section 3401 and has had money withheld from
    their paycheck since 1942 has been a victim of
    government sponsored propaganda and theft

    Pollack case where the Court lambasted the Feds,
    for their robbery

  • The injustice and harm which must always result
    from overthrowing a long and settled practice
    sanctioned by the decisions of this court could
    not be better illustrated than by the example
    which this case affords. Under the income-tax
    laws which prevailed in the past for many years,
    and which covered every conceivable source of
    incomevast sums were collected from the people
    of the United States. The decision here rendered
    announces that those sums were wrongfully taken,
    and thereby, it seems to me, creates a claim, in
    equity and good conscience, against the
    government for an enormous amount of money

  • I say, creating a claim, because, if the
    government be in good conscience bound to refund
    that which has been taken from the citizen in
    violation of the constitution, although the
    technical right may have disappeared by lapse of
    time, or because the decisions of this court have
    misled the citizen to his grievous injury, the
    equity endures, and will present itself to the
    conscience of the government. Pollock v. Farmers
    Loan Trust Co., 157 U.S. 428 (1895) (Pollock
    I). 157 U.S. at 637-38.
  • I was once told that The government has no
    conscience. That is the U.S. government is a
    corporation. You must decide what you will do
    with this information. Use it for your betterment
    or continue to cave under their pressure.
