Every state has a statute of limitations, which
is essentially a timeframe within which a lawsuit
must be filed. If you attempt to file a lawsuit
after time runs out on the statute of
limitations, it is unlikely your case would be
heard in court.
In North Carolina, the statute of limitations
for filing a car accident claim is generally
three years, beginning on the date of the
accident. There are a few exceptions to the rule
such as if the victim was a minor at the time of
the accident. Moreover, if the car accident
resulted in the death of a loved one, the statute
of limitations is two years, the beginning of the
date of your loved ones death.

Waiting Too Long to File a Claim
Although you have three years to file a car
accident claim, it is best to give yourself
plenty of time to file the lawsuit. Even if you
believe your case is pretty straightforward, to
make sure you do not miss out on an important
deadline, contact an attorney as soon as possible.
4
In addition, some insurance coverage requires
advance written notification of your intent to
accept liability coverage in order to pursue
additional coverage that may be available.
Failing to do so could limit your ability to
receive additional compensation.
