What are Notified Bodies ?
  • they are bodies notified by Member States to the
    European Commission and to the other Member
    States
  • only these bodies are authorized for carrying
    out conformity assessment procedures with respect
    to one or more New-Approach-Directive(s) relating
    to
  • certification,
  • inspections and/or
  • testing

Which tasks do Notified Bodies have ?
  • only notified bodies are to be involved in
    the conformity assessment procedures
    under New-Approach-Directives
  • they undertake specific tasks within the
    framework of the systems 1, 2 or 3 of the CPD
    (e.g. initial type testing, inspections,
    certification)
  • the manufacturer is free to choose any notified

What is the purpose of the CE-Marking ?

The CE-Marking
  • means compliance of a product with the essential
    requirements of one or more EU-Directives
  • is addressed to the governmental market
    surveillance authorities only
  • indicates the declaration of the manufacturer
    that the legal provisions of all EU-Directives
    relevant for the product have been observed
  • is therefore affixed to the product or its
    packaging by the manufacturer or supplier on his
    own responsibility
  • is the precondition for placing a product on the
    European market (EEA)

The CE-Marking of construction products
indicates
  • that a construction product (also) fulfills the
    requirements of the Construction Products
    Directive, i.e.
  • the compliance with the relevant reference
    document, either
  • a harmonized European Standard (hEN) or
  • a European Technical Approval (ETA)
  • and the application of the relevant system of
    conformity attestation specified in the hEN or in
    the Guideline for the ETA (according to the
    respective decision of the Commission)

The CE-Marking
  • is not a quality mark
  • is not a mark showing conformity with standards
  • is not a certification mark, therefore it cannot
    be licensed or withdrawn
  • has a single meaning, i.e. the compliance with
    legal provisions
  • stands for different contents, depending on the
    topic of the respective EU-Directive

What forms the basis for the CE-Marking of
construction products ?

The basis is the Construction Products
Directive
  • Council Directive of 21 December 1988 on
    the approximation of laws, regulations and
    administrative provisions of the Member States
    relating to construction products
  • Number 89/106 EEC
  • Notified 27 December 1988
  • Publication 11 February 1989, in the Official
    Journal of the European Communities L 40
  • Implementation by till 30 months after
    notificationthe Member States (27 June
    1991)

The Construction Products Directive (CPD)
  • enables - in spite of the aim in the title - the
    continuation of existing different levels of
    protection in the Member States
  • states Essential Requirements (ERs) for the
    construction works
  • relates to matters subject to national
    regulations only
  • refers to Technical Specifications,
    construction products must comply with, i.e.
    -harmonized
    European Standards (hENs) or
    - European Technical
    Approvals (ETAs)
  • provides the CE-Marking of construction products

Changes due to the New Approach
  • EU-Directives contain, instead of detailed
    requirements, protective targets in form of
    Essential Requirements (ERs) only
  • harmonized European Standards (hENs)
    lay down the detailed requirements on
    products(ordered by a mandate of the
    Commission)
  • introduction of the CE-Marking the manufacturer
    indi- cates therewith that both the Essential
    Requirements as well as the procedures for the
    Attestation of Con-formity of all relevant
    EU-Directives have been kept

The CPD is a unique New Approach-Directivebecau
se
  • the 6 Essential Requirements of the CPD do not
    apply to construction products but to
    construction works
    therefore
    direct Attestation of Conformity against the
    Directive and subsequent CE-marking without a hEN
    or ETA is not possible !
  • the 4 systems for Attestation of Conformity of
    the CPD do not follow the moduls of the Global
    Approach, as this approach has been resolved
    after the publication of the CPD.

The CPD only applies to construction
products which
  • are placed on the EEA-(European Economic Area)
    market
  • are intended to be incorporated permanently in
    buildings and civil engineering works, covering
    e.g. cement, heating equipment up to
    prefabricated houses
  • are intended for use in construction works which
    are subject to regulations in one or more Member
    States
  • contribute to satisfaction of at least one
    Essential Requirement for the construction
    works.

  • are to be satisfied, subject to normal
    maintenance, for an economically reasonable
    working life (durability!)

CE-Marking of Construc-tion Products - FAQs (1)
  • 1) What I have to mark ?Each construction
    product, for which a harmonized EN or a
    guideline for a European Technical Approval (ETA)
    exists and the transitional period for the
    CE-marking has already expired.
  • From what date on I am allowed or I have to mark
    ?Possible as soon as a hEN or a guideline for a
    ETA is valid, i.e. as soon as the transitional
    period for the CE-marking has started.
  • Mandatory as soon as the transitional period
    has been expired, i.e. in case of a hEN as soon
    as the national standard has to be withdrawn (DOW
    Date of withdrawal).
  • 3) What I must not mark ?Products not covered by
    the CPD or for which (still) neither a hEN nor
    a guideline for a ETA exists.

4) May I already use the CE-mark ?Only if
already a harmonized EN or a ETA (with or
without guideline) for your product exists and
the transitional period for the CE-marking has
started. 5) What are the preconditions for me
to mark ?I must already run a factory production
control (FPC) for the product in question and
this product has already passed the necessary
procedure of attestation of conformity. 6) What
happens if I dont mark ?I may not put the
product on the European market (EEA European
Economic Area).
