  • Robert Adams Did not wish to drive said vehicle
    due to the fact that it was lacking a required
    inspection sticker, which in this case would
    cause him to do a illegal act.
  • If this was merely an unethical act then yes
    Robert would be eligible to be fired. But since
    the sticker was required, to follow his orders
    from his boss he would have to break the law.

Conclusion
  • (Reason) An action for wrongful discharge in
    violation of public policy is an action in tort,
    rather than in contract. Liability is grounded in
    the principle that the employer may not retaliate
    against an employee by discharging that employee
    for refusing to break the law. The employer
    engages in tortuous conduct by affirmatively
    forcing the employee to choose between breaking
    the law and keeping his job. The wrongful
    discharge of an at-will employee in violation of
    public policy is thus an intentional tort.
  • For the remedies of lost wages Robert Adams would
    win the full 7,094 dollars.

  • For the compensatory damages of 200,000 in
    emotional distress and humiliation, he would have
    to prove the following.
  • (1) extreme and outrageous conduct on the part of
