January 26 Overview
  • Continuation of the discussion with Steve Durant
    Seth Brown about how a new industry has sprung
    up wherein companies that neither produce IP,
    products or services have acquired critical
    technology in the form of Intellectual Property
    and begun to invite infringers to license
    their IP or face the threat of a willful
    infringement lawsuit.
  • Willful infringement of course means treble
    damages.
  • So the corporate target must get an expensive
    legal opinion or settle early OR get a legal
    opinion and litigate.

Purpose of the Exchange
  • The purpose of the Exchange is to
  • Create a safe place to discuss issues among your
    peers.
  • Build better ideas and creative concepts by
    bouncing those ideas off one another.
  • Share successes and failures that will help your
    colleagues be more successful within your own
    companies.
  • Identify issues that need to be researched and/or
    developed.

  • IP is becoming a new focal point in business
    strategy. How you engage your colleagues in other
    departments commonly determines the effectiveness
    and efficiency with which you can help them
    become knowledgeable and effective in the
    creation, protection and extraction of value in
    your company.

    how to deal with the new growing industry of
    Stick Licensing so that you and your company
    may develop better strategies to deal with this
    growing concern.

  • Whats the big deal? Thats why we have
    patents to protect our creative and innovative
    process.
  • Why should we care whether or not the patent
    falls into the hands of a entity whose sole
    business is extracting value from that patent.
    Wouldnt a good licensing operation anywhere be
    doing the same thing?
  • We used the word extortion in a tongue in
    cheek reference in the title, but would we want
    to stop this practice would we want a different
    set of protocols new laws?

Taskforce Plan

    scope and design for a survey of corporations
    regarding this new industry/tactic. (Early March)
  • 2. Conduct a survey of corporations under the
    aegis of the Taskforce ITAA. (April)
  • 3. Convene a summit where the report is discussed
    and action steps are explored and developed.
