    thru the Army Surface Deployment and Distribution
    Command (SDDC)

  • Can use DoD-sponsored, contractor-issued GTC to
    pay for rental car
  • However, BOA does not provide rental car
    insurance (VISA USA provides limited
    collision/theft coverage)

  • Actions to take if youre in a rental vehicle
    accident
  • Immediately call the police and file report, get
    a copy
  • Notify your supervisor ASAP
  • Notify the rental company ASAP
  • Call VISA USA (if applicable using
    1-800-VISA-911)
  • Maintain copies of all documents, including
    rental car agreement, maintain chronology and
    contact nearest base/post legal office to report
    the accident

LINE OF DUTY INVESTIGATIONSFOR AIR NATIONAL
GUARD CASES
  • Air Force Instruction 36-2910, Line of Duty
    (Misconduct) Determination, 04 October 2002
  • AFI 36-2910 applies to the U.S. Air Force, the
    Air National Guard, and the USAF Reserve.
    Process is similar to Army rules.
  • Caveat Chapter 3 has specific procedures for
    members of the Air Reserve Component (ARC - the
    Air National Guard and USAF Reserve).

LOD CASES - ANG
  • Questionable Circumstances cases must go to
    ANG/DP. These cases have
  • Misconduct, alcohol/drugs, incidents in travel
    to/from inactive duty training (IDT), athletics
    and on-base injuries before/after IDT.
  • Conditions that existed prior to service (EPTS)
    and have service aggravation.
  • A disease process (all cardiac cases, heart
    attacks, artery disease, cancer, diabetes, etc).

  • Failure to forward Questionable Circumstances
    cases to ANG/DP can delay cases, because these
    are not final until HQ ANG action.

  • USAF Integrated Process Team (IPT) met 25 Apr
  • 2005, to review LOD policies and recommend
  • changes for ARC mission.
  • IPT considered LOD process in context of current
  • ARC roles and deployments. More information to

  • revised.
  • 14-17 Mar 05, ARPC, Denver JA DP staff from
  • ARPC, AFRC and ANG meet.
  • Expect updates and revisions, but no major
  • changes.
  • Draft to be coordinated. No firm release date.

SA UPDATE SA DEFINITION
  • Dr Chus 13 Dec 04 said SA is
  • Intentional sexual contact with use of force,
    physical threat, abuse of authority, or when
    victim does not or cannot consent.
  • Consent is not failure to offer physical
    resistance. Consent is not given when a person
    uses force, threat of force, coercion, or if
    victim is asleep, incapacitated or unconscious.
  • A crime, such as rape, nonconsensual sodomy
    (oral anal sex), indecent assault, or attempts
    to commit these acts.

SA UPDATE - THE FUTURE
  • - JTF SAPR sent Army trainers to Iraq, Qatar,
    Kuwait Afghanistan in Apr 05 to teach military
    members the new SA definition.
  • - NGBs SA Working Group (SAWG) created Mar 05.
    Reviewing Army, USAF, DOD and DOJ materials for
    use in NGB SA programs.
  • - Full-time NGB SA Response Coordinator (SARC)
    hired Apr 05.
  • - NGBs SAWG and NGB SARC will create a Joint SA
    Response Plan.

SA UPDATE - THE FUTURE
  • A SARC will be hired for each state territory
    to implement DOD NGB guidance and create local
    programs.
  • Programs must consider local laws, conditions,
    and resources for victims.
  • Programs will implement DTMs, with more victim
    support, better case accounting, more training,
    pre-deployment training, better responses to
    allegations, coordination with local agencies,
    and improved response capability.
  • Programs must work in new confidentiality
    climate.

SA UPDATE - THE FUTURE
  • Each SARC will need help from the NG team. Law
    Enforcement, Chaplains, Public Affairs, JAs and
    others need to offer help, suggestions and
    resources to build the most responsive local
    programs possible.
  • Expect additional guidance from JTF SAPR and
    NGB, but local personnel will be the ones
    ultimately dealing with victims and cases.
    Thorough plans for local assistance are
    essential.

SA UPDATE - LEGAL ISSUES
  • Can VWAP materials, programs, processes be
    tailored to the new SA response programs?
  • USAF/JA created a DocuShare collection of
    materials . NGB SAWG is reviewing those and
    other Army, AF, DOD DOJ materials.
  • These materials will have to be reviewed and
    revised to comply with new policies, such as
    Restricted Reporting.

SA UPDATE - LEGAL ISSUES
  • The new SA guidance focuses on helping victims.
    What about the duty status of a National Guard
    member?
  • What programs, care, help funding will be
    available to a National Guard member?
  • What will be available to a member victimized in
    Title 10 status, but possibly some distance away
    from Active Duty units bases? Or after they
    leave Title 10 status?

SA UPDATE PRACTICAL CONCERNS
  • SA program must prevent heal assaults. It must
    work well for members employees in Title 10
    Title 32 Status. It must be effective at home,
    in CONUS OCONUS.
  • Teamwork will be essential! We need your ideas,
    help support.
