  • Has broader changes relating to content service
    regulation
  • Closing date for comments is 29 Nov

  • This is covers changes to the restrictions on
    access
  • Closing date for comments is 16 Nov

Proposed MPSD changes
  • Repeal of content related provisions
  • ACMA proposes to remove all of the provisions of
    the MPSD that relate to the restriction of access
    to content, content classification complaints
    in relation to these issues
  • These issues will now be covered by
  • Schedule 7
  • RAS Declaration
  • Numbering Plan

  • Maintain chat safety measures
  • ACMA proposes to repeal these provisions
    eventually
  • It is a matter of timing with the new Content
    Services Code
  • If the chat safety measures in the new Code are
    acceptable, then ACMA will repeal the provisions
    in the MPSD

Proposed MPSD changes
  • 195 and 196 Prefixes
  • The MPSD prohibits the supply of age-restricted
    content by SMS/MMS unless on 195 or 196 numbers
  • Proposal is to remove this from the MPSD
  • Same obligation will be contained in the
    Numbering Plan

  • Replace MPSI Scheme
  • Content Services Code will contain provisions in
    relation to restricted access to content,
    classification and complaints
  • Remaining provisions of MPSD and the MPSI Scheme
    following all the proposed changes relate to
    consumer protection issues eg pricing
    information, how to unsubscribe, promotion of
    services
  • Proposal is to replace with a consumer code under
    Part 6 of the Telco Act

RAS Declaration
  • Access key
  • This is a new requirement
  • An access key is
  • a password
  • a PIN
  • any other means by which a person whos been
    granted access can be identified
  • An access key must not be allocated unless the
    age of the applicant has been verified
  • Access to restricted content must not be given
    unless a person has entered an access key

  • Risk analysis
  • This is a new requirement
  • Risk analysis must identify and assess the risk
    that the kind of evidence could be used
  • by a person other than the person it purports to
    identify
  • by a person younger than the age set out in the
    evidence
  • Risk analysis must take into account
  • the kind of evidence of age provided
  • the manner in which the evidence is received

  • Quality assurance measures
  • These are the same as in the MPSD
  • These cover issues like
  • Procedures to be followed by employees to
    implement age verification measures
  • Measures to ensure effectiveness of employees in
    implementation
  • Measures to enable identification of any faults
  • Procedures for periodic internal audit
  • Procedures to ensure a report is written after
    the audit
  • Procedures to ensure the report is given to a
    person who has the authority to implement any
    recommendations in the report
  • Maintain age verification records

Other changes
  • MPSI Scheme is being updated to remove content
    classification complaints requirements these
    are covered in the Content Services Code
  • MPSI Guidelines are also in review separate
    exercise, mainly focussing on PSMS practices
