• AENV issues final terms of reference
• AST/Hazco close to submitting EIA to AENV
• Based on final terms of reference.

• AENV and NRCB begin technical review
• EIA is made available to the public
• Public can file statements of claim

• AENV and NRCB go over point by point
• If deficiencies exist report is sent back to AST
  for more information /or clarification
• Generally all EIAs have deficiencies

• AENV deems EIA complete
• Public and stakeholders can file objections with
  the project
• When EIA is deemed complete NRCB publishes fact
  in local paper

• How did the NRCB become involved?
• Large public interest through letters petitions
• This triggered AENV to involve NRCB

• In July 2006 order in council was passed
  requesting the project comes under the
  jurisdiction of NRCB

NRCB Process 3 Segments

• Information session
• Determines issues
• Pre-hearing Conference
• Grouping of topics
• Intervener funding
• Hearing Scheduled
• Board members receive information from EIA
• Intervener experts
• Stakeholders presentations

• NRCB issues a hearing report about 3-4 months
  after Hearing
• Approve
• Approve with conditions
• Deny

• If approved NRCB asks for a cabinet authorization
  via order in counsel
• Appeal process can occur
• Based only on a technical matter of law
• Have 30 days to appeal
