Noise and leisure activities
  • Have an influence on the environment because of
  • The noise which is generated on the premises and
    which is transmitted to the outside and adjoining
    buildings.
  • Changes in crowd capacity of other sources due
    to
  • Traffic
  • Big crowds
  • It is not much relevant on the exterior influence
    (noise map).
  • They are the biggest cause of complaints in
    relation to noise in towns.

The authority
  • The authorities have created efficient laws and
    regulations that involve
  • Actions on the rooms.
  • Actions on the control of the sources.
  • Actions on the circumstances around the crowd
    capacity of the sources.
  • Inspection and control actions.

  • Although the law is complete, much of the problem
    is not solved yet.
  • The application of the norms is relatively
    efficient when the premises start their activity.
  • However, it turns out slow and inefficient when
    following the activities.
  • When affected citizens complain they set-up a
    legal mechanism which is slow and useless on many
    occasions. This implies that citizens only
    complain when the situation is unbearable.

The problem

    sometimes the problem is already altered when the
    authorities intervene.

    important annoyance due to noise activities.
  • Only 30 would legally complain to solve the
    problem.
  • Even so, they are the cause of most of the
    complaints received by the environmental
    services.

The solution
  • The competent national authority in Castilla Y
    León proposed authorities inspection as a method
    to solve the noise problem.
  • Systematic inspection and control (automatic
    inspection)
  • The implantation of a universal inspection system
    that affects all the activities is an expensive
    task that involves the use of a big number of
    technical and human resources which lack on many
    occasions.
  • Use technology to create an automatic inspection
    system.

Towards an efficient inspection system
  • An efficient system must be able to
  • Identify in an efficient way the different
    activities which take place in the area according
    to the characteristics given by their licence.
  • Report all the incidents that happen within the
    development of such activities and may affect the
    correct use of the characteristics given by the
    licence.
  • An efficient system must be reliable enough, so
    that the obtained data appears within reasonable
    limits.
  • An efficient system must put liability on the
    inspected activity, so that the burden of proof
    falls under its responsability.

  • On which would be based the working of such a
    system?
  • - Inside every venue there can be a maximum
    sound pressure level, so
  • that transmission levels required by law,
    which depend on soundproofing,
  • are fulfilled.
  • - Keeping the venues levels under the maximum
    spectrum guarantees fulfilment of the law.
  • - The noise there is inside a venue depends on
    the sources there are inside
  • and specially on the crowd capacity.

Implementation of the system

  • Acoustic cataloguing of the venue.
  • To obtain the maximum spectrum.
  • Give the licence under the condition of
    fulfilment of that maximum sound spectrum.
  • Control of the activity
  • - With the installation of a device that
    sends reports of the activity
  • (sonograph).
  • - Require from the owner of the venue the
    proper performance of the
  • control device.

Legal requirements
  • To clearly define the characteristics of the
    control element.
  • To make it clear that it is the responsability of
    the owner of the venue to keep the control
    element working under right conditions
  • Owners must have the control elements mentioned
    by the XX and YY articles working in a proper
    way. That is the reason why the aforementioned
    devices must be included in a maintenance
    programme certified by a recognized entity, which
    ensures the proper working of the systems, as
    well as the verification of the measurement
    system, which must be carried out at least once a
    year.
  • It is the obligation of the owner of the
    activity to presented the updated documentation
    of the currently in force maintenance contract as
    well as the certificates which prove the proper
    working of the system.

Why is the system so innovative?
  • Communications are not done as an infringement
    but as a failure in the control device.
  • The law compels to keep the device under perfect
    working conditions.
  • The system daily and automatically generates the
    notification requiring that the maintenance
    technician certifies which has been the cause of
    failure and sets the device working again.
