  • Definition of Special Waste
  • Special waste is waste that is included in the
    hazardous waste list and has certain properties
    as stated in the Special Waste Regulations 1996
    (SI 1996/972)
  • Special Waste is
  • waste that is listed with a six digit code in
    Part I of Sch 2 of the Regulations and displays
    any of the properties given in Part II of Sch 2
    or
  • displays hazardous waste properties specified in
    Part II of the Schedule unless below a specific
    threshold
  • or
  • a waste prescription-only medicine.

    consists of clinical waste, asbestos or any
    mineral or synthetic oil or grease

  • The Notification of Consignments (1)
  • Purpose is to track waste
  • Consignment notes are given a unique number by
    the Environment Agency (fee payable)
  • The consignment note describes the waste and
    certifies the role of each of the parties in the
    transportation of the waste

  • The Notification of Consignments (2)
  • The Consignor notifies the Environment Agency by
    sending copy to the Agency
  • Consignor retains copy
  • Consignment then transported between 72 hours and
    one month after notification. Carrier retains
    copy
  • Consignee receives waste and a retains copy
  • Consignee sends copy to Environment Agency to say
    it has arrived.

  • The Notification of Consignments (3)
  • If a load is rejected by the consignee he or she
    must notify the Environment Agency together with
    the reasons for rejection.
  • The carrier then has responsibility for the waste
    who must return it to Consignor or to another
    consignee.
  • Special arrangements apply to small quantities of
    waste collected regularly by a carrier from a
    number of consignors on a round.
  • Each round must not last more than 24 hours.
    Season ticket/schedule type booklet used.

  • Producers of hazardous waste must keep records
    of
  • the quantity,
  • nature,
  • origin,
  • destination frequency of collection and
  • mode of transport and
  • method of disposal of the waste that they
    produce.

  • Consignors keep notes for 3 years
  • Carriers keep notes for 1 year
  • Consignees keep notes for 3 years plus record of
    disposal operation

    liability of directors, managers due to consent
    connivance or neglect.

  • It is a defence to show that a defendant was
    not reasonably able to comply with the
    provisions by reason of an emergency or grave
    danger and that he or she took all steps as were
    reasonably practicable in the circumstances for
  • a) minimising and the threat to the public or
    the environment and
  • b) ensuring that the provision in question was
    complied with as soon as reasonable practicable
    after the event.
