5Review Criteria (Zoning Petition)
A land use district boundary may not be amended
unless there is substantial evidence that
- The proposed land use district is consistent
with - The standards for district boundaries in effect
at the time - The Comprehensive Land Use Plan
- The purpose, intent and provisions of this
Chapter - The proposed district designation is more
appropriate for the protection and management of
existing uses and resources within the affected

6Review Criteria (Public Hearing)
- Chapter 4, Section 4.04(5)(b) gives the
Commission discretion to hold a public hearing.
The Commission shall consider public interest and
likelihood of information presented at the public
hearing to be helpful. - Chapter 4, Section 4.06(4) states the Commission
shall review requests for public hearing in
accordance with Administrative Procedures Act.
If five or more interested persons request a
public hearing, one must be held.

suitability of site soils - To date, no other comments have been received

8Staff Recommendation
Due to the significant amount of public interest
received (43 requests, only 5 required) and the
potential impacts on the areas character, staff
recommends the Commission grant the requests for
a public hearing. Staff anticipates a public
hearing could be held in early August, 2005.
