Background of the Project
  • In the course of Animal Health Extension
    Services Project implementation, both Canadian
    and Chinese hopes to understand in-depth animal
    health legal system and legislation mechanism of
    each other, and all believe that studying those
    are all-important to the project.
  • In addition, The Animal Epidemic Prevention Law
    of PRCis emending, which need a series of
    matching regulations. At present, Matching
    Regulation Study Project goes along ,and matching
    regulations are under making, and several
    regulations should refer to habitual rules of the
    world and good experiences of developed country.
    So both Canadian and Chinese experts reach
    consensus to the project, and China-Canada
    cooperation project, Animal Health Extension
    Services Project office decides to begin the
    study, and carry out by Qingdao Oriental Animal
    Health Law Science Institute. The research
    keystone is animal health legal system of Canada,
    and hope to provide some habitual rules and good
    experiences for China.

Whole Target of Project
  • Comparative Study of the Legislation (Acts and
    Regulations) Covering Animal Health in China and
    Canada wants to find differences and
    similarities through studying on legislation and
    regulations of animal health on China and Canada.
    The highlight differences and these points could
    be suggested to Chinese authorities, legislative
    changes are considered for inclusion in the law
    or in its supporting regulations.
  • In order to achieve the purposes, our priority
    studied the animal health legal system of Canada,
    compared the legislation of China and Canada, and
    summarized some advanced experiences for China.
    Working group hopes this project could be better
    implemented by participators and implementers
    under animal health legal system. At the same
    time, these could provide reference to Chinese
    animal health legislation.

Working Achievements in 2007
  • 1. Gathering and Formalizing the Related
    Materials
  • Working group has collected 36 acts and
    regulations of Canada, analyzed and studied all
    those materials and formed research report.
  • During study of the project, workgroup held 6
    seminars and participated several China-Canada
    Project policy proseminars, and translated 12
    acts and regulations of Canada.

Comments and Suggestions
  • To propose China government to sparkplug the
    enterprise-promotion mode in legislation
  • To refer to the advanced experiences of Canada in
    the stipulation of matching-regulations on animal
    health in China.
  • Making stamping-out policy should refer the
    helpful experience of Canada
  • To do follow-up research of this subject

Follow-up Research
  • 1. Time and Fund of Follow-up Research
  • In order to study more systematically, workgroup
    advice to use another 3years seizing the details
    of Canada animal health legal system and the
    expect expenditure of all of the works are
    150,000 Canadian dollars.

  • 2. Plans of every year
  • (1)In the year of 2008
  • In 2008, work group will emphasize on
  • studying of the law and regulation of
  • veterinarian and disease control.
  • (2)In the year of 2009
  • In 2009, work group suggest the study
  • emphases should be put on the field of
  • animal-origin food safety and inputs (refer
  • to feeds and animal drugs).
  • (3)In the year of 2010
  • On the basis of the research from 2007 to
    2009,
  • it is considered that studies of animal
    protection
  • and welfare should be the research emphases in
  • 2010, so as to make Chinese animal health to
  • reach a new level.

  • 3.Advantage of Setup and Staff
  • As a non-profit registered NGO, Qingdao Oriental
    Animal Health Law Science Institute is a unique
    research institute of this kind in China. It is
    engaged in research, consultation, cultivation,
    training and legal services of animal health.
    Including those who graduated, 5 doctors and 22
    masters had made their contributions here, Lead
    by experienced expert Prof. Chen Xiangqian, on
    research programs regarding Animal Health.

  • The main duty of the institute includes research
    on conditions and theories of legal norm and
    legal system of foreign and domestic animal
    health, training of internal and external animal
    health law, consulting service and legal services
    on animal health legal affairs for internal and
    external clients, and cooperating with relevant
    educational institute on training postgraduate
    students in the area of animal health law
    science.

  • Since this institute was founded in June 2000,
    more than ten essential research programs were
    accomplished. Such as Reformation of Veterinary
    Management System, Comparative Studies on Animal
    Health Law Science, Research of Applied Mechanism
    of SPS Agreement, Research of Settlement of
    Disputes on International Trade about Animal
    Products, Official Assessment of Technical Trade
    Measure on Animal Health, etc. additionally this
    institute had taken part in several missions of
    drafting out the bills on animal health. Most of
    the research results were adapted by the
    government during the reformation of the National
    animal health system and the legislation on
    animal health.
