  determine if errors exist or if there are logical
  problems with their construction

  spectrum use efficiency

Proposed compliance rules

• Anatel to establish IME for each service as a
  condition of use
• Terms of compliance to be embedded in regulation
• Efficiency rule (Art.31) is
• EUE gt or IME, and
• ITE (temporal EUE) of last 12 months gt or 0
• Term for adjusting operation of existing
  licensed stations to new conditions will be
  reduced proportionately to the licensees
  efficiency indices but no longer than 6 months
  (Art. 32 provides proportionality formula)

Compliance process

• Data gathered by Anatel from licensee
• Quarterly for named services (anytime for other
  services)
• Licensee has 6 month period to adjust data
• Existing systems must provide past 24 months
• Anatel performs analysis
• Database accessible to licensees for data inputs
• If noncompliant, procedure for verification is
  initiated

  apply if deemed noncompliant

• Failure to report data
• Inefficient use of spectrum (especially, failure
  to fulfill commitments specified by Anatel,
  interruption of spectrum use may harm competitive
  market, service quality issues)
