- Commencing with the Nov Magistrate Court,
Soldiers who are - caught driving while intoxicated may be tried
in Magistrate Court - This will ensure fairness, uniformity and a
permanent record - throughout the country for all DUI/DWI
offenders - Brigade Commanders may request UCMJ authority if
they determine - that is a more appropriate route
- Units may still pursue administrative grade
reduction but not UCMJ - if a Soldier is tried in Magistrate Court
- Punishments at Magistrate Court range from fines
to jail sentences - of up to a year. For first time DUI offenses
with BAC under .149 jail - sentences are generally suspended, for BAC over
.149 at least 48 - hours minimum jail time
- Drivers who are caught driving on a license
suspended as a result of - a DUI conviction face mandatory jail time
