  • Direct Payments legislation
  • Community Care (Direct Payments Act) 1996
  • Direct payments can be made to disabled people
    aged 18-65 (later extended to people over 65) who
    are willing and able to consent to this.
  • Carers and Disabled Children Act 2000
  • Direct Payments also made available to the
    parents of disabled children and to carers
  • The Health and Social Care Act 2000
  • Local authorities are required to offer Direct
    Payments to all eligible individuals.

  • Provide information about all aspects of Direct
    Payments.
  • Provide assistance to advertise, recruit and
    develop good relationships with workers.
  • Provide information and advice about training and

    into separate components - personal care, health
    care, social care. Its a holistic approach . .
    . it all contributes to the well-being and health
    of the whole person.

  • Direct Payments can not
  • be made for health services
  • It has been suggested that we should extend
    the principle of individual budgets and direct
    payments to the NHS. We do not propose to do so,
    since we believe this would compromise the
    founding principle of the NHS that care should be
    free at the point of need. Social care operates
    on a different basis and has always included
    means testing and the principles of self and
    co-payment for services.

  • Summary
  • Implementing the NSF for Long Term Conditions
    gives service providers the opportunity to work
    in partnership with disabled people.
  • Together we can turn ideals such as meaningful
    involvement and choice and control for people
    who use our services into reality.
  • In the crucial area of joint packages of care
    that include Direct Payments, because of the
    restrictions still in place, there is a long way
    to go.
