  • The new law exempts water distribution products
    which are not regulated and are under the control
    of the sponsor of the bill.

Engaged our California lobbyist early in the
process February 1 (AB 1953 was introduced the
next day). Important Note Our position was
not to defend lead

Our position was to endorse performance-based
standards as the only true way to assess water
quality and product safety.

We continue to promote the value and importance
of performance-based standards like NSF
61. Drafted for NAHB a resolution to support
performance-based testing, which was unanimously
approved at the June NAHB Board Meeting.

PMI created a broad coalition of associations,
manufacturers, certification bodies and other
groups to oppose the bill. The coalition even
included a water utility from southern California

Met with the sponsor and author of the bill to
establish a dialogue and to explain our issues
and position. Provided the sponsor with a
tutorial on faucet construction complex NOT
monolithic. Our outreach and good faith effort
resulted in the formula which is now part of
the law.

Sponsors introduced new, false and misleading
data prior to each vote taken in the house and
senate committees and on the floor Planted
articles in the Sacramento Bee and then
referenced them (There is Poison in Your
Faucet) Sponsors made false claims of our
members compliance, including a manufacturer who
stopped selling products in California during the
Prop 65 days. (Central Brass)

Sponsors referenced a list of 24 manufacturers
already providing lead-free faucets (to this day
has never revealed any names) Sponsors cited
industry support the California Metals
Coalition does not represent our industry and
whose membership includes no faucet
manufacturers.

At the 11th hour on the last day of the session
last September, and with political pressure from
many, Governor Schwarzenegger signed the bill
into law. The Governor acknowledges our points
and recognizes the flaws with the bill. His
office continues to work with us.

We, as an industry have big challenges ahead
BUT now that the bill is law, we are committed
to obeying the law.

SB 651 is a PMI-sponsored clean-up bill designed
to clarify ambiguous language in the new law. Its
author is Senator Ron Calderon (D) Our goal is
to clarify and strengthen the bill not weaken
or alter the intent. The January 1, 2010 date
of implementation and the concept of
performance-based standards are off-the-table.

PMI testified at the Senate Environmental
Quality Committee hearing on August 28 in
Sacramento. Senate Environmental Quality
Committee Chairman Joe Simitian, (D) a noted
environmental policy leader in the Capitol
provided PMI with an excellent and objective
forum in which to present our case.

Three of our four points were addressed by the
Committee which cited precedents for definitions
and intent. We are seeking documentation of
these interpretations. It was felt by the
committee that this clarification removed the
urgency of SB 651 and the pressure to resolve
the matter by the end of the session (September
12th)

Our key point Though the requirements have been
legislated, compliance can only be determined
by 3rd party certification. Lets not use
litigation as enforcement! SB 651 will be taken
up in the next session January 2008.
