Enforcement Perspective

• High level of individual officer discretion

• Action driven by goals, priorities, and standards

• Any ticket was a good ticket.

• More strategic use of warnings and tickets, with
  an understanding of the costs associated with
  various approaches, and an assessment of whether
  the enforcement action is changing behaviors.

• Arbitrary quota system for violation notices and
  prosecutions, not necessarily tied to compliance
  issues / problems

• Heavier reliance on administrative hearings and
  internal processes

• Philosophy of jump out of the bushes and
  catching the industry in the act.

• Based on incentives / disincentives and rewards /
  education

• Based on seeing industry as perps

• Based on long-term relationships and seeing
  industry as customers (focus energy on the worst
  offenders)

Vehicle Inspection Bylaws

• Vehicle must comply with standards
• An owner or broker shall not permit the operation
  and no driver shall operate a Livery vehicle
  unless the Livery vehicle is free of the defects
  listed in the Livery Vehicle Inspection Standard.
• When vehicle fails to comply
• When a Livery Vehicle is found to be in a
  condition that fails to comply with the Livery
  Vehicle Inspection Standard
• if the defect is of such a nature that it is a
  potential risk to continued safe vehicle
  operation, as defined in the Livery Vehicle
  Inspection Standard, have the defect repaired
  within a period not to exceed 14 days or,
• if the defect is of such a nature that it is a
  more serious safety concern that can deteriorate
  quickly, as defined in the Livery Vehicle
  Inspection Standard, have the defect repaired
  within a period not to exceed 24 hours or,
• if the defect is a serious defect that risks safe
  vehicle operation, as defined in the Livery
  Vehicle Inspection Standard, immediately cease
  operation as a Livery Vehicle and have the defect
  repaired or,
• if the defect is such an imminent safety hazard
  that continued vehicle operation is prohibited,
  as defined in the Livery Vehicle Inspection
  Standard, immediately cease operation of the
  Livery Vehicle until the defect is repaired.

• Offences for operating unsafe vehicles
• Any driver who operates and any owner or broker
  who permits the operation of a vehicle with a
  defect that a serious defect that risks safe
  vehicle operation, as defined in the Livery
  Vehicle Inspection Standard, or a defect that is
  such an imminent safety hazard that continued
  vehicle operation is prohibited, as defined in
  the Livery Vehicle Inspection Standard is guilty
  of an offence.
• Order vehicle inspection
• If there are reasonable grounds to believe that a
  Livery Vehicle is being operated in a condition
  that fails to comply with the Livery Vehicle
  Inspection Standard, an ltltofficergtgt may order the
  Livery Vehicle to undergo an inspection carried
  out in accordance with the Livery Vehicle
  Inspection Standard at a Vehicle Inspection
  Station licensed in accordance with the
  requirements of Division 5.

• Periodic inspection required
• An owner or broker shall not permit the operation
  and no driver shall operate a Livery vehicle
  unless the Livery vehicle carries proof of
  successfully passing an inspection carried out in
  accordance with the Livery Vehicle Inspection
  Standard at a Vehicle Inspection Station licensed
  in accordance with the requirements of Division
  5, within the preceding 6 months.
• Driver to inspect vehicle
• A driver of a Livery Vehicle shall complete an
  inspection of the vehicle for the presence of
  defects listed in the Livery Vehicle Inspection
  Standard before operating the Livery Vehicle.
• Upon discovery of any defect listed in the Livery
  Vehicle Inspection Standard, a driver shall
  report the defect to the owner of the Livery
  Vehicle and the Broker.
