Background

• In 2005 NTIA agreed that the 5 system capacity
  was valid measure of the de minimis activity
• At OPSCOM 39 NOAA proposes the 5 system
  capacity be managed by the OPSCOM Terms of
  Reference
• NOAA proposed new language to section 3.1.2 of
  the Terms of Reference
• Note based on the ConRep update the ToR was
  incorporated into section three of the report
• One comment was received during the
  intersessional period from Emilie Bruchon to
  change the introduction to "to review reports of
  non-environmental use of spare capacity to ensure
  it does not exceed

TOR Edit

• NOAA recommends editing Section Objectives of the
  Operations Committee
• to review reports of non-environmental use of
  spare capacity to ensure it does not exceed the
  de minimis value of 5 of the system capacity or
  interfere with environmental use of the system.
  System capacity is defined in the paper The Case
  for a 5 of Argos System capacity limit on non
  environmental applications.
