Scotland future demographics and Fresh Talent
rationale
  • Fresh Talent launched in Feb 2004. At that time
    Scotlands population was projected to fall below
    5 million in 2030s. However recent projections
    show our population likely to be around 5.5m by
    2033.
  • Dependency ratio (number of children and
    pensioners to workers) forecast to increase - 60
    per 100 workers in 2008 68 per 100 workers by
    2033
  • So we still need people of working age to come
    to Scotland

  • Set up Relocation Advisory Service (web, phone,
    face to face)
  • Based in Glasgow with 6 staff including an
    immigration specialist (Nina Russell) and
    business team (Employers Toolkit, case studies,
    e-newsletters)
  • Almost 24,000 customers assisted from over 150
    countries
  • India (18.6) China (10.5) Poland (10)
    Nigeria (7) USA (6.5)
  • Established websites with information about
    living and working in Scotland
  • over 1million visitors to www.scotlandistheplace
    .com
  • simplified Chinese and Polish versions also
    available

New immigration Points Based System
  • All non-EEA immigration into UK now on a Points
    Based System
  • Tier 1 - highly skilled individuals
  • Tier 2 - skilled workers to fill gaps in UK
    labour market
  • Tier 3 limited numbers of temporary low skilled
    workers (suspended)
  • Tier 4 students
  • Tier 5 - youth mobility and temporary workers
  • Education institutions/employers wishing to
    bring in migrants to work, study or train under
    tiers 2-5 must apply to go on Register of
    Sponsors.
  • Tier 1 you own the visa more flexible
  • Competence in English language now generally
    required.

Tier 1 the 4 sub-categories
  • Tier 1 for highly skilled individuals replaced
    schemes such as Fresh Talent Working In Scotland
    Scheme (FTWISS), HSMP, IGS, Innovators etc
  • Post Study Work after successful completion of
    studies in the UK
  • General for highly skilled employment in the UK
  • Entrepreneurs for those setting up or taking
    over the running of a business in the UK (200k
    investment)
  • Investors for those making a substantial
    investment (1m) in the UK

Tier 1 Post Study Work
  • Post Study Work (PSW) replaced FTWISS in July
    2008.
  • PSW very similar to FTWISS 2 years leave to
    remain.
  • Now UK-wide international students studying
    anywhere in UK can apply for PSW and can work
    anywhere in the UK.
  • Kind of Work
  • you dont need a job offer to apply for the visa
  • no restrictions on type of job
  • can be self employed
  • Time in PSW does not count towards settlement.
  • However, before your leave has expired you can
    consider switching into another category in Tier
    1 or into another Tier (e.g. Tier 2).

Tier 1 Post Study Work criteria
  • Must score 75 points from 4 categories
  • Qualification (20 points) - degree Postgraduate
    degree Postgraduate Certificate in Education
    Professional Graduate Diploma in Education HND
    from Scottish institution
  • Institution (20 points) - UK institution which is
    on the Tier 4 sponsors list
  • Immigration status in UK during period of study
    (20 points) obtained qualification in UK with
    leave to enter/remain that was not subject to a
    restriction preventing applicant undertaking a
    course of study
  • Timing (15 points) must make application within
    12 months of date of award
  • Applicants in this sub-tier will be deemed to be
    competent in English language skills. There is
    also a maintenance assessment.

Post Study Work Documents required and cost
  • Must send 2 recent passport photos and Passport
    with
  • proof of the following
  • Original certificate of award
  • Original letter from college/university
  • Maintenance
  • Cost postal applications within UK 500 same
    day service at UKBA office 700. Dependants added
    with your application 50 otherwise 465 (665
    at UKBA office)
  • Out of country applications 265. Dependants also
    265

Date of award and letter fromcollege or
university
  • Date of award is not the date of graduation it
    is the date you are first notified in writing or
    by the institution publishing details of the
    award via a notice board or on its website.
  • a letter must be provided by the institution
    confirming applicants name title of
    qualification start and end dates of period of
    study date of award.
  • If certificate is not available the letter must
    also confirm details of awarding body explain
    why the applicant is unable to provide their
    original certificate and confirmation that the
    certificate will be issued.

Maintenance
  • Maintenance you must be able to show you can
    support yourself.
  • If applying from within the UK 800. If applying
    from out with UK 2,800
  • Must be in your bank account for at least 3
    months at all times before your application.
    Evidence must be dated no more than one month
    before applying.
  • If you have on-line statements you require a
    supporting letter from bank or each page of the
    statements should bear official stamp of the
    bank.
  • Must be cash shares, bonds, pension funds or
    agreed overdraft facilities are not acceptable
  • Maintenance for Dependants
  • If the main applicant is outside the UK or has
    been present in the UK for less than 12 months an
    additional 1,600 per dependant is required.
  • If the main applicant has been in the UK for 12
    months or more 533 is required for each
    dependant.

Tier 1 - General
  • Awarded initially for 3 years (can be extended
    for a further 2). Must score 75 points or more in
    4 categories.
  • Qualifications Masters 35 PhD 50.
  • Previous earnings scale from 20k - 22,999
    15 pts 23k-25,999 20pts 26k-28,999
    25pts 29k-31,999 30pts 32k-34,999
    35pts 35k-39,999 40pts 40k plus 45 pts
  • Age under 28 20 points 28 or 29 10
    points 30 or 31 5 points
  • UK experience previous earnings or
    qualification obtained in UK 5 points
  • In addition applicants must pass English
    language test and maintenance assessment.
  • NB - change from 1 October 2009 only previous
    earnings relating to the 15 month period
    immediately prior to applying will attract points

Tier 1 GeneralDocuments required and cost

Earnings in Foreign Currency
  • These will be converted into pounds sterling
    using the closing spot exchange rate for the last
    day of the period claimed in that currency.
  • The exchange rate is that which appears on
    www.oanda.com
  • Once converted earnings will be multiplied
    according to country or territory the currency
    was earned in e.g.
  • China 3.2
  • India and Pakistan 5.3
  • Ghana and Nigeria 11.4
  • Earnings can be claimed in different currencies
    these will be converted and multiplied before
    being added together.

Tier 2 for skilled workers
  • Work Permits were replaced by Tier 2 from Nov
    2008.
  • Employer must now register with the UK Border
    Agency for a sponsorship licence to be able to
    employ a migrant worker under Tier 2.
    Applications are made on line
  • Small companies (as defined by Companies Act
    2006) and charities - 300
  • other companies/organisations - 1000
  • Once registered the organisation will be placed
    on-line in the Register of Sponsors List
  • Sponsor must pay for each person they wish to
    sponsor under Tier 2 the cost for this is 170
    (plus 465 or 265 to be paid by the worker).

Tier 2 General sub-category
  • Job must be
  • on the UK or Scottish Shortage Occupation List
  • If not, the Resident Labour Market Test to be
    conducted jobs of 40k and under must be
    advertised for 2 weeks. Over 40k one week is
    sufficient
  • Job must be at least skill level N/SVQ 3
  • Job must pay appropriate salary
  • Employer applies to the UKBA for a certificate of
    sponsorship for each individual they wish to
    employ the employee requires this as part of
    their qualifying for entry clearance (if outside
    the UK) or for extending their stay (by switching
    from Tier 1 or Tier 4).
  • The employee must then score at least 70 points
    (which must include 10 for English language and
    10 for maintenance) ?

    switching from Post Study Work 30pts
  • Qualifications below degree (A level) 5pts
    bachelors or masters 10pts PhD 15pts

    10pts 22k-23,999 15pts 24k or more 20pts
  • Maintenance 10 pts
  • English language 10 pts
