Ofsteds role in improvement
  • Local authority retains the role to provide
    information, advice and training to childcare
    providers
  • Ofsteds role
  • improvement through inspection and monitoring
  • improvement through enforcement arrangements
  • provide information to other authorities such as
  • Her Majestys Revenue and Customs local
    authorities

Ofsteds escalating tariff
  • Same principles as now
  • Seek to bring about improvement without formal
    enforcement action wherever possible
  • Will take enforcement action when
  • the provider cannot improve without external
    support
  • the provider is unwilling to improve
  • children are at risk of harm

  • Notice of action to improve (non-statutory)
  • Enforcement notice (unregistered childminding)
  • Welfare requirements notice (compliance notice)
  • Suspension of registration
  • Impose/remove/amend conditions of registration

Changes from September 2008
  • Can cancel childminder registration (both
    registers) if not provided childminding for more
    than three years
  • Possible one month notice for prosecutions for
    failing to comply with welfare requirements
    notice
  • No welfare requirements notice for learning and
    development
  • Cannot cancel registration if time for welfare
    requirements notice has not passed

Welfare requirements
  • Very similar to current arrangements under
    National Standards
  • Providers must
  • meet welfare requirements
  • have regard to guidance in section 3 of the
    statutory framework
  • Offences similar to now, for example
    non-compliance
  • Some minor changes in events to be notified to
    Ofsted (such as notifiable diseases)

Learning and development requirements
  • No statutory compliance or requirements notice
  • Not an offence not to comply but Ofsted can
    take non-compliance into account when taking
    other enforcement action
  • New arrangements monitoring inadequate category
    2 provision
  • Need to consider how long we continue to monitor
    before we take other steps, for example
    cancellation
