Summary of Activities

• Filling and Grading In 2003 and 2004, the
  respondents filled and graded approximately 6,000
  square feet to within 2 feet of the NHWM. The
  area was not properly stabilized until 2004.

• Deck Reconstruction In 2003, an existing
  nonconforming deck was removed in conjunction
  with other activities. In 2004, a replacement
  deck and a new deck were constructed without
  approval in violation of SA EC 94-227.
• - SA 94-227, arranged with a previous owner,
  prohibited any new construction that is
  not in full compliance with existing setback
  requirements.

Other Violations

• Prior to transferring the property to the
  Payeurs, Paul Masse, constructed a new
  nonconforming shed without approval, 16 feet from
  the road and 4 feet from a side lot line.

Settlement Conditions

• Pay a 2,000 civil penalty.
• Relocate the unapproved shed in 2007 according to
  a permit from the Commission.
• Also in 2007, remove and properly dispose of the
  new 4 foot by 8 foot lakeside deck.
• Disclose the terms and conditions of this permit
  to any person acquiring interest in the property.
  Record this agreement at the Fort Kent Registry
  within 10 days of ratification.
• Development on the lot within 100 feet of
  Madawaska Lake is limited to the existing camp
  and additions including the existing
  reconstructed deck.
• Comply with BP 6854 as amended and the SA for EC
  94-030.
