    contracting opportunities. BC is particularly
    interested in the participation of minority and
    women businesses in BC procurements.

  • A business smaller than a given size as measured
    by its employment, business receipts or business
    assets
  • Strengths
  • Considered race/gender-neutral not subject to
    strict scrutiny legal standard
  • Can utilize set-asides
  • Can rely on other agency SBE certifications or
    self-certification through tax forms or financial
    statements
  • Weaknesses
  • Does not make distinctions among small businesses
    that fall below a certain threshold
  • Does not permit targeted activity towards
    specific groups within the small business
    category
  • Has greater potential of resulting in a reduction
    of MWBE expenditures

Definition of Small Disadvantaged Business
Enterprise Program
  • A firm that is at least 51 percent owned by one
    or more individuals that are socially and
    economically disadvantaged
  • Social disadvantagea person who has experienced
    social disadvantage in the US as a result of
    causes not common to persons who are not socially
    disadvantaged
  • Economic disadvantagea socially disadvantaged
    individual who ability to compete in the free
    enterprise system has been impaired due to
    diminished capital and credit opportunities as
    compared to others in the same or similar line of
    business who are not socially disadvantaged.

  • A firm that is at least 51 owned, operated and
    controlled by a woman or a member of a recognized
    minority group, including Asian Americans,

  • Requires the conduct of a disparity study
  • Requires a certification process
  • Set-asides are increasingly frowned upon

  • Self-certification processBC will accept all SDB
    certifications submitted, with an affidavit
    acknowledging that misrepresentations can result
    in denial of certification, inability to
    participate in BC contracting opportunities

  • Auditing processOn a yearly basis, BC will audit
    a percentage of certifications submitted to
    ensure that vendors are submitting true and
    accurate information as to their status as a
    socially and economically disadvantaged business.
