4Introduction
- The AES Unit has been in existence since the mid
1970s - We are the primary Pesticide Safety Education
Program (PSEP) for Texas
5- We have subject matter Specialists in weed
science, entomology, agronomy, and agricultural
education - We provide support through training and
educational material development
6Objectives
- To provide an update on pesticide laws and
regulations for the TDA, SPCB and the Texas
Department of State Health Services (TDSHS) - To discuss the TCE license requirements for CEAs
and Specialists - To discuss the Private Applicator training
procedures
7- To discuss TCE protocol for conducting CEU
programs and activities (subject matter, course
approval, and utilization of educational
materials) - To provide information about the licensing
procedures for the various regulatory agencies
8TCE License Requirements
- TCE CEAs Ag, ANR, EA IPM, Hort, Marine, Extension
Associates, Extension Assistants, and Ag
Specialists are required to obtain Noncommercial
applicator licenses - Each CEA or Specialist must pass the general,
LRs, and a category exam (OT, Weed Brush)
9Demonstration Research
- In addition, each CEA or Specialist needs to pass
the DR category examination - This allows TCE personnel to conduct research
activities in the category they are licensed in
(OT, Weed Brush)

- DR also allows TCE CEAs and Specialists to use
unregistered pesticides, EUPs, and numbered
compounds
11Demonstration Research
- This year, we plan to develop a Demonstration and
Research manual. - Meanwhile continue to use the practice problems
available.
12- However, it is not necessary to have an
applicators license to conduct applicator
certification or recertification activities or
programs
13Agricultural Applicator Licensing Requirements
- TDA licenses applicators engaged in the
production and maintenance of agricultural
commodities - Individuals can license as Commercial,
Noncommercial, and Private applicators
14Private Applicator Training
- TCE CEAs and Specialists conduct a three hour
minimum certification program. It make take up to
four hours to complete a program or activity. - They can use the DVDs, VHS tapes, or slide sets
to conduct the courses. - Training programs can be for groups or
individuals.
15Private Applicator Training
- Every County has been sent a DVD with the
complete Private Applicator Training on it. - Every County was sent the DVD not every CEA.
16Private Applicator Training
- Each Section has the introduction, whatever Video
is appropriate to the subject, followed by the
review questions and answers.

- The address label was made out to the Agriculture
agent so if you are an EA-IPM, HORT or EA-ENTO
you need to talk to the AG agent and get the DVD. - We sent out about 250 copies of this DVD and NONE
have been returned so someone in each county has
received the DVDs.

- Please request that the office staff help to
locate the DVDs. - Some CEAs may not have a DVD player.
- You can purchase DVD players for as low as
30.00 or 40.00.

- The reason we price the Private Applicator manual
to County Agents for 10.00 is to support
applicator training programs. - CEAs can sell 2 or 3 of manuals and have what is
needed to purchase a DVD player.

- The funds derived from manual sales are intended
to support Pesticide Safety Education Program
(PSEP) activities only.

- We have heard from a number of people who have
tried to play the DVD on their computer and
project it from the computer that have had
problems. - Not all disc players on computers will read/play
DVDs. Only drives that are DVD compatible will.

- Each DVD was tested on a DVD player in our office
and worked fine before it was sent out. - If you have a DVD that does not work, please send
it back and we will replace it.

27Noncommercial Applicator Requirements
- Any employee of business or agricultural
establishment who uses or supervises the use of
RU pesticides, SLU pesticides, or Regulated
Herbicides as a part of their job must obtain
this license
28- To obtain a noncommercial license applicants must
pass the general, LRs, and a category
examination
29- Persons working under the supervision of
political subdivision noncommercial applicators
must receive 5 CEUs annually - OR
30- The employee must be trained on the appropriate
LRs pertaining to pesticide use, the label
information for the use of all pesticides that
are applied and pesticide safety training
31- Since September 2004, persons under the
supervision of a noncommercial applicator must
work from the same office or location, - OR the noncommercial applicator must be
physically present during the application
32Commercial Applicator Requirements
- Persons who use or supervise the use of RU or SLU
pesticides, and Regulated Herbicides for hire on
the property of others to produce agricultural
commodities must obtain this license
33- Also, individuals who are landscape contractors
with a Class 1 Nursery Floral Certificate must
obtain a commercial applicators license to
maintain OT plants around homes and businesses
34- These individuals must pass the general, LRs,
and a category examination
35- A minimum of 100,000 for property damage for
each occurrence and 100,000 for bodily injury
for each occurrence or an aggregate of 200,000
for each occurrence in financial responsibility
must be maintained at all times

37Continuing Education Units (CEUs)
- All County Agents are constantly asked to provide
Continuing Education Units (CEUs) for
applicators. Here are a few things to remember
38CEUsNO Correspondence NO Home Study
- NEVER send a video home with an applicator to be
watched and returned to receive credit. This
type of activity is considered CORRESPONDENCE
or HOME STUDY. Extension has NOT been
approved to provide this type of credit.
39CEUsNO Correspondence NO Home Study
- Offering Correspondence or Home Study CEUs adds a
burden that Extension does not need. - 7.24 Applicator Recertification states
- Each activity must include an open book measure
of competency and - Procedures must be established to prohibit an
individual from repeating the same course in two
consecutive recertification periods
40Videos for CEUsin the Office
- The agent does not need to be the person
providing the video but the activity must be in
the Extension Office. - IF an applicator needs to get a quick CEU, he
MUST watch the video in the Extension office or
other monitored location. - The secretary can set-up and turn on the video
and instruct the applicator on how to run the
equipment.
41Correspondence CEUs are available from Private
Providers
- Private Applicators can take up to 10 of their
CEUS by correspondence in each 5 year renewal
cycle. - Commercial/Non Commercial Applicators can have
correspondence CEUs only every other year

43TDA has changed the renewal process.
- TDA sends the renewal form and asks that the
applicators simply pay their fees and return the
form or renew electronically via the internet.
44TDA does not ask the applicator to list their
CEUs at this point.
- This change allows the renewal process to be more
speedy and frees up some time to do additional
audits.
45Applicators are still responsible for
self-certification
- this means that each applicator MUST keep up with
their Completion Certificates so they can find
them when needed.
46TDA officials maycheck these certificatesin two
ways.
- Any time a TDA Inspector is interviewing an
applicator, he may ask to see the proof of CEUs
for the last renewal period. - Also, TDA may request that copies of Completion
Certificates be sent to Austin for an audit.
47Emphasize to your producers that they MUST keep
up with their Completion Certificates.
- If an applicator is audited or if an inspector
asks to see the certificates and the applicator
does not have proof of CEU completion, he could
lose his license and/or be charged an
administrative penalty for not having the
required documents.

56Roster Submission
- Sponsors of all approved activities must prepare
a roster of applicators that attend the activity
which contains, at a minimum, the date, course
number, the pesticide applicator's name and
current license or certificate number and the
location (please include city and county) of the
training.
57Roster Submission
- Send the activity rosters to TDA within 14 days
after the end of an activity. - Retain a copy of each roster in your office for
one year following the activity. - The rosters must be on department forms or
approved formats and ensure that CEUs awarded
correspond proportionately to the net instruction
time.
58Completion Certificates
- Completion Certificates must be provided to the
applicators who successfully complete an activity
at the completion of the activity.
59Completion Certificates
- The information on the Completion Certificate
must match the information on the roster
including the name of the sponsor, the date,
county and name of the activity, the amount and
type of credit earned, and the assigned course
number.

62TDA Rosters
- You should read through the list and re-write any
name that may be difficult to read. - TDA would prefer that for a large group, all of
the names should be alphabetized and typed to aid
the applicator auditing process but this is not
required.
63For Texas OpenRecords Act
- The final depository of the roster is with TDA so
they will have each roster on file. - If someone needs to see a roster, they would need
to provide the information needed to file the
roster. - It is NOT possible to look up rosters using a
persons name.
64How are CEUs calculated?
- There must be a 11 ratio of one CEU per hour of
actual instruction time (spent on appropriate
content). - A 60 minute activity equals 60 minute credit.
65How are CEUs calculated?
- This can be 50 minutes of instruction and 10
minutes of Questions and Answers. You can
build some thought provoking questions into your
program. - During the question session make equipment
changes as needed to be ready for the next
speaker.
66How are CEUs calculated?
- It is NOT legal to shave 10 minutes off of each
of 6 - 1 hour - talks and then give 6 hours
credit for only 5 hours of instruction. - Each 1 hour presentation should have 1 hour of
time (i.e. 60 minutes) allowed on the program for
it.
67How are CEUs calculated?
- Do not include time allowed for breaks, room
changes, speaker changes, welcomes, etc. - You may elect to give fractions of CEUs in 1/4
increments e.g., 1.25 CEUs for 75 minutes or 0.5
CEUs for 30 minutes. - When in doubt, round down.
68CEUs should be awarded only upon completion of
the continuing education activity.
- You may elect to award partial CEUs to an
applicator for partial completion. - This usually is affected by logistics, such as
availability of staff or volunteers to monitor
the arrival and departure times of program
participants.
69CEUs awarded to individuals who sign the roster
- Completion Certificates will not be issued unless
the applicator has registered by signing the
roster and provided either a applicator license
number or a social security number.
70Course content
- Course content must be appropriate for education
of pesticide applicators, see 7.24 Applicator
Recertification in the Laws and Regs Manual
(B-5056) for appropriate CEU content.
71Sales presentationsare not considered
appropriate CEU material.
- Company reps can present scientific information
about their products such as mode of action,
persistence, pest spectrum, special instructions
or warnings found on the label, how the product
would fit into an IPM program, etc. - There is a lot of good information that can be
presented without making a sells pitch.
72What is self-certification?
- This is a confusing State term that could be
explained as an automatic license renewal
process. - The process is the same for both private and
commercial/noncommercial applicators, as well as
for applicators licensed by the Structural Pest
Control Board.
73Before a license expires, the licensee receives a
renewal form from TDA.
- The licensee must certify that he or she has
met continuing education requirements. - Upon receipt of the completed renewal form, TDA
automatically issues a new pesticide applicator
license.
74Self-certification andRandom audits
- At a later date TDA will randomly select
applicators for auditing. - During an audit TDA will compare Completion
Certificates to course rosters to verify actual
attendance. - Fraudulent CEU records are cause for a fine from
10,000 to 25,000 per violation.
75TDA does not track CEU records for individual
applicators.
- It is imperative that applicators obtain a
certificate of completion for each continuing
education activity they attend. - Certificates serve as CEU receipts to help
licensees report their continuing education
record to TDA.

- Certificates should NOT be attached to the
renewal form, nor sent to TDA in lieu of the
form. - Completion Certificates should be retained by the
applicator for one year after renewal.

hospitals, parks recreational settings and
structures are required to license with the SPCB

103Who needs TDSHS License?
- Anyone in Texas who works with restricted use or
state-limited use pesticides must be licensed or
under the direct supervision of someone who is
licensed. - Direct supervision means that the licensed person
is available (not necessarily present) to give
directions and answer questions.
104Who may supervise?
- TDSHS Noncommercial applicators may supervise
unlicensed seasonal employees in a mosquito
control program.
105Who is a seasonal employee?
- A seasonal employee is an individual hired for
peak mosquito control periods who acts under the
direct supervision of a TDSHS licensed pesticide
applicator in the vector control category.

seasonal employee
- has received training in the required laws and

- Each noncommercial pesticide applicator licensed
by the department must meet the license renewal
and recertification requirements set out in Texas
Administrative Code, Ch 25, Pt 1, 267.8. Among
these requirement are the completion of TDSHS
approved continuing education activities for
recertification.
