    collective bargaining under attack.
  • National collective agreement for metalmechanic
    sector (CCNL). Renewed in 2005
  • after 80 hours of strikes. Wage incremental of
    100, absorbed by IBM for 75 of
  • the employees.
  • LAW 30/2003 (labour market restructuration)

  • The actual left government is planning to review
    this law.
  • FREEDOM OF SPEECH
  • guaranted by Costitution and regulated by
    governamental institutes.

Company environment
  • COUNTRY-WIDE AGREEMENTS WITH TRADE UNIONS
  • 41 agreements between IBM and national works
    council, since 1956.
  • Main topics vacations, working time, factory
    dismissions, offshift working time and
    regulations,
  • pension fund, telework,
  • COMPANY LEVEL AGREEMENT
  • 1) Presented in 2004 to IBM. No availability to
    discuss.
  • 2) New agreement elaborated in 2006 by all IBM
    unions, and approved by all italian employees
  • in a referendum (2792 workers agreed, majority).
  • IBM was interested to discuss about a company
    level agreement (due to low internal climate ?)
    and
  • during the discussion Increased the initial
    budget for the agreement from 3,5M to 5M.
  • After 6 meetings between national workscouncil,
    unions and IBM, the bargaining was interrupted at
    the
  • end of May due to low offers of IBM and the
    attempts to obtain worst condition for new
    employees.
  • 4 hours strike in all IBM locations on 28th of
    May.
  • We are now planning new initiatives to involve
    employees and re-open the discussion

  • Are negotiations really productive?
  • PARTIALLY. Before 2000, IBM used to sign many
    union agreements with
  • a negotiation. Since last years IBM appears to be
    no more interested in good
  • industrial relations and its closed to most of
    discussions.
  • Are laws really applied?
  • YES, but IBM stops exactly in the line of the
    law.
  • It seems to do some more steps over the law on
    some sensitive topics
  • environments, corporate social responsibility.
  • Is there any trade unions regulationsprotection
    for trade-union workers representatives YES
  • time reserved for trade-union activities YES
  • trade union work councils representing workers at
    different levels in the company (site,
    entreprise, group, inter country work councils)
    etc. YES

IBM Employees 1991-2006
Lost ½ of workforce in 15 years !
Data without subsidiarian workers
In 2005 restructuration lost 1200 employees. IBM
used public and private package incentive to
leave. Law procedure for 510 involuntary
separations to push the employees (then
retired) 2006 98 employees accepted for
voluntary separation packages. 2007 reported new
voluntary resignations.
