  • Plaintiffs acts were unforeseeable and thus
    they were not negligent. There had been few past
    injuries at the hospital.

Acting as the attorney for the Plaintiff, argue
why the MDMH (defendant) breached its duty to
care towards the Plaintiff and was thus
negligent.
  • A hospital is under a duty to exercise reasonable
    care to safeguard a patient from any reasonably
    apprehensible danger to lock doors and to have
    safety screens on windows, and be aware of
    patients location. P should have been under
    special observation due to previous suicide
    attempt. There was insufficient observation and
    security that allowed the escape attempt to
    occur.
