  • Any school or library that receives discounted
    rates for Internet access, Internet service or
    internal connections under the E-Rate program,
    or receives funding through the Library Services
    Technology Act or Title III of the Elementary
    and Secondary Education Act, in order to purchase
    computers used to access the Internet, or to pay
    for direct costs associated with accessing the
    Internet, must comply with the Childrens
    Internet Protection Act (CIPA). Additionally,
    libraries and schools that receive E-Rate support
    must also comply with the Neighborhood Childrens
    Internet Protection Act (N-CIPA), which requires
    the adoption of very detailed Internet Safety
    Policies.

Overview
  • Schools need an Internet Safety Policy
  • Procedures include public notice and/or meetings
    with the LEA or school administration entity
    responsible.
  • Requirements (other than filtering) must address
    access to appropriate materials, safety and
    security using e-communications, hacking, and
    unauthorized disclosure of identification
    regarding minors. Pg 4 sec b
  • Inappropriate material and harmful to minors
    clauses require LOCAL efforts to apply measures
    which go beyond filtering. These might include
    determinations of prurient interests, offensive
    depictions of sex, or a lack of serious literary,
    political, artistic or scientific value to
    minors.
  • Specific technology that blocks or filters
    Internet Access to specified material. Pg 6 sec 3

Further limits for E-rate
  • E-Rate requirements are more strict.
  • It is not legal to provide on-the-spot override
    of a web site which is wrongly blocked. It must
    be processed by the company. Pg 8 pa 2
  • When adults use school or library computers, the
    administrator MAY disable the software. There are
    no requirements for honoring a bona fide request.

  • Filtering is not limited to visual depictions.

  • E-RATE currently does not pay for Internet
    Filtering software, but . . .
  • Schools must certify they are either filtering or
    undertaking actions. (10/28/01)

Deadlines
  • Certification by 10/28/01 for E-rate (yr 4)
  • Already filtering or undertaking actions.
  • Certification by application period of E-rate
    (yr 5 1/15/02) that district/school/library is
    filtering.
  • Waivers only for bidding or procurement
    problems.
  • Certification by application period of E-rate
    (yr 6 1/15/03) that district/school/library is
    filtering.
  • NO waivers
  • Failure to comply makes the school ineligible for
    E-rate

Compliance
  • The FCC has indicated it will rely on check-off
    certifications.
  • USDOE is allowed to enter into compliance
    agreements and to apply criminal penalties for
    fraudulent information.
