The Board of Governors (BOG) approved the
following Distance Education (DE) Regulations in
March 2002, and in July 2002, the Secretary of
State adopted the regulations.
  • The regulations set forth the recommendations
    made by the Chancellors Office (CO) and the
    system wide advisory group, Distance Education
    Technical Advisory Committee (DETAC).
  • The approved regulations continue to allow
    California Community Colleges to explore and
    develop educational initiatives using advanced
    communication and computing technologies to
    address student access issues related to
    geographical, cultural, disability or facility
    barriers.

Distance Education Technical Advisory Committee
  • Purpose
  • To advise the Chancellors Office on strategies
    on implementation and evaluation of distance
    education for the system and to assist in the
    development and enhancement of community
    colleges distance education programs by
    providing technical assistance and related source
    materials on good practices.

55205. Definitions and Application.
  • Distance education means instruction in which the
    instructor and student are separated by distance
    and interact through the assistance of
    communication technology. All distance education
    is subject to the general requirements of this
    chapter as well as the specific requirements of
    this article. In addition, instruction provided
    as distance education is subject to the
    requirements that may be imposed by the Americans
    with Disabilities Act (42 U.S.C. Sec. 12100 et
    seq.) and section 508 of the Rehabilitation Act
    of 1973, as amended, (29 U.S.C. 794d).

DSPS Origin
  • The Disabled Student Programs and Services
    (DSPS) was enacted in 1976 through the passage
    of AB 77 (Lanterman), which funded support
    services and instructional programs for students
    with disabilities in the California Community
    Colleges.

CAPTIONING DEFINITIONS
  • Real-time (live) Captioning
  • Captions which are simultaneously created and
    transmitted during a class, video program or
    conference. A trained steno-typist does this
    on-site or remotely. Most real-time
    captioningis shown in a scrolling style.
  • Closed Captioning
  • Captions that appear only when special equipment
    called a decoder is used. Closed captioning is
    typically used for broadcast television and for
    videocassettes of movies which are widely
    distributed.

WHY MUST WE LIVE CAPTION?ITS THE LAW
  • According to the U.S. Department of Education,
    Office for Civil Rights (OCR), responding to an
    ad-hoc accommodation request by an individual
    student with a disability is not enough to
    satisfy compliance requirements for distance
    education courses.
  • Distance Education courses must be designed in
    such a way that the level of communication and
    course taking experience is the same for students
    with or without disabilities.

CHANGES TO CCC LIVE CAPTION
  • All qualified CCCs have minimum baseline
    funding. Live captioning billing over baseline
    funding will be paid in full on a
    first-come-first-serve basis while funding is
    available.
  • New application and funding steps
  • CCCs will submit applications to CCC Live
    Caption for funding.
  • Upon approval of funding, CCC Foundation will
    notify designated captioning vendor of CCC
    approval.
  • Captioning company will work out details with
    college to provide live captioning services.
  • The captioning company will bill the CCC
    Foundation directly for services.
  • Turnaround time for reimbursement of live
    captioning expenses to qualified CCCs has been
    shortened to 7-10 business days from submission
    of the reimbursement application (if college has
    already paid for captioning services).
