2What is abuse?
- Physical Injury substantial risk of serious
physical injury) - Cruel/grossly inappropriate procedures or devices
to modify behavior - Commits, permits, or encourages the commission of
a violation of law - Emotional Damage
- Encourages, directs, or approves of delinquent
acts involving moral turpitude
3What is neglect?
- A juvenile does not receive proper care,
supervision, or discipline has been abandoned
or is not provided necessary medical care or is
not provided necessary remedial care or lives in
an environment injurious to the juvenile's
welfare.
4Responsibilities of All Staff
- IMMEDIATELY
- Safeguard the juvenile
- Secure the scene
- Remove any persons from the area
- Ensure no one enters the area
- Assign staff member to meet law enforcement to
escort them to the scene - Notify your supervisor the on-site supervisor

- Report the incident to County DSS
- Cooperate with the DSS Investigation
- Complete Sign Part 1 of the Serious Incident
Report (Form DJJDP6 001)

7Responsibilities of Supervisors
- Ensure involved juveniles are safeguarded
- Ensure the scene is secure
- Ensure DSS was notified
- If not, immediately notify the Director of DSS
and - Document the oral notification to DSS and any
information received. - Retain copies of all documentation and evidence
in a locked cabinet. - (Secured information shall only be released under
the direction of the Director of Administrative
Services) - Notify the Facility Director/CCC of actions taken

- Review Part 1 of the Serious Incident Report
- Complete Sign Part 2 Supervisor Reporting
- Immediately notify your supervisor (or 1st
uninvolved supervisor) - Send notification through the chain of command up
to the Assistant Secretary level - When facility staff are allegedly involved,
immediately separate the alleged abused/neglected
juvenile from the alleged perpetrator - (Dir. Of Admin Services shall be notified for
staff that do not have an Assistant Secretary in
their chain of command)

Court Counselor
- Ensure involved juveniles are safeguarded
- Ensure the scene is secure
- Ensure actions taken are documented on the
Serious Incident Report - Immediately notify your supervisor
- Notify Law Enforcement

Court Counselor (Cont.)
- Ensure DSS was notified
- If not, notify the Director of DSS and
- Document the oral notification and any
information received - Retain copies of all documentation and evidence
in a locked cabinet (This information shall only
be released under the direction of the Director
of Administrative Services) - By telephone, notify the juveniles court
counselor - By telephone or in-person, notify the juveniles
parent/legal guardian (if not involved in the
incident)

Court Counselor (Cont.)
- Utilize administrative placement options as
necessary - Review Part 1 Part 2 of the Serious
Incident Report - Complete and Sign Part 3 of the Serious
Incident Report - Send copies of all collected information,
including the Serious Incident Report, to DSS,
by the next business day - Facility Directors If the alleged abuse is not
sexual abuse, authorize a non-invasive body check
to verify physical injury. - This check shall be documented on Form YC/M 019,
Body Check/Injury Verification
13When May the Reporting Process be Closed?
- Report already made to DSS and confirmed
- DSS Confirmation documented and filed
- Alleged perpetrator not associated w/DJJDP
- Juvenile not in care/custody of DJJDP
- Facility Director/Chief Court Counselor informs
AA, who informs the Director of for Admin
Services of the decision.
14When is Local Law Enforcement Notified for
Juveniles in DJJDP Facilities?
- Juvenile harmed in violation of criminal statute
- Alleged victim of abuse/neglect in custody of or
receiving services from DJJDP is 18 years of age
or older - If a juvenile abuses/sexually assaults another
juvenile
15What if a Juvenile Abuses Another Juvenile in a
DJJDP Facility?
- Involved juveniles shall be separated
- Law enforcement notified
- Matter referred to DSS for investigation of
possible neglect - Serious Incident Report form completed
- Facility Director/Chief Court Counselor ensures
that all reporting requirements are met
16Training Requirements
- You are required to receive refresher training on
this policy every year. - Document this training on DJJDP7 005 (Policy
Training Record) send to Policy Manager - All new hires will receive training on this
policy during orientation - Local DSS staff will be invited to view
Department approved use of force techniques
annually - All facility staff shall receive training
regarding proper methods of securing the scene of
a death or suspected sexual assault.
