CHILD CUSTODY and SUPPORT
2When you are going through a divorce as a parent
child custody and support issues are going to
be important.
3- In this presentation we will look at some basic
information that you need to know.
4CHILD CUSTODY
5- The matter of child custody does not fit under a
single umbrella.
6There are two distinct types of custody that
must be considered
7Legal Custody
Legal custody is oftentimes going to be shared by
both parents.
8This type of custody gives a parent the power to
make decisions that are relevant to the welfare
of the child.
9- These would include educational and
health-related decisions.
10Physical Custody
Physical custody is for the most part
self-explanatory. This form of custody involves
the child's physical place of residence.
11With a joint physical custody arrangement the
child would spend a relatively equal amount of
time living with each parent.
12- Primary physical custody would involve the child
residing with one parent. The other parent would
generally have visitation rights.
13WHO GETS CUSTODY?
14Custody arrangements can be agreed upon by both
parents with the best interests of the children
in mind.
15- If the parents simply cannot come to an agreement
the court will be forced to make custody
decisions.
16CHILD SUPPORT
17Under California law both parents of a child
are responsible for his or her financial support.
18Either party may be required to pay child
support to the other.
19However, in most cases the custodial parent will
be the recipient of child support payments.
20How Is Child Support Calculated?
21The amount of child support that must be paid is
calculated based on a rather complex formula.
22This formula is partially based on the income
that is earned by each individual.
23This formula is partially based on the income
that is earned by each individual.
The other factor is the percentage of time that
the child spends residing with each parent.
24Child Support Agreements
25The divorcing parents can come to a private
agreement with regard to child support payments.
26- However, to protect the well-being of the child
the court must approve of this agreement.
27This is a very brief overview. If you are going
through a divorce as a parent you would do well
to discuss everything with a licensed attorney.
