Title: MINIMUM STANDARDS for DRIVER LICENSES

1
MINIMUM STANDARDS for DRIVER LICENSES
DMV-ISSUED ID DOCUMENTS Presented by Jay
MaxwellPresident COO, AAMVAnet, Inc.
2
Who is AAMVA?
  • American Association of Motor Vehicle
    Administrators
  • Established in 1933
  • Non-profit, tax exempt
  • Membership
  • All U.S. and Canadian jurisdictions
  • U.S. and Mexico federal governments
  • Over 150 associate members
  • Provides forum for information exchange
  • Promotes uniform practices and reciprocity

3
Who is AAMVAnet?
  • AAMVAs IT Division
  • Established in 1988
  • Non-profit, tax exempt
  • Operate a private, secure network that connects
the states (ATT Global Network Services)
  • Operate nationwide information systems for the
    DMV
  • Commercial Driver License Information System
  • National Driver Register
  • National Motor Vehicle Title Information System

4
Operating a Motor Vehicle
  • Its a privilege, not a right. You can lose that
    privilege if you
  • prove that you are a hazard on the road
  • fail to pay court-ordered child support
  • fail to pay for the gas you just pumped
  • fail to pay library fines

5
The Drivers License
  • Created to indicate that you have passed the
    appropriate skills and knowledge tests.
  • Primary customer - law enforcement
  • Primary user - private industry
  • Airlines
  • Retail
  • Banking
  • Anyone that has a secure building

6
The Non-Driver ID
  • Law enforcement asks for your drivers license.
  • Private industry asks for your government-issued
    photo ID.
  • Private Industry has, to date, created the
greatest need for Americans to carry an ID.
  • In response, driver licensing agencies have, as a
service, been issuing non-driver IDs to those
    that ask for them.

7
Driver Licenses ID Cards
  • Identification Needed to Get One
  • (aka Breeder Documents)
  • Birth Certificate (6,000 valid forms)
  • Social Security Card
  • Passport
  • IRS Tax ID Number
  • INS Documentation
  • Driver License (this is changing!)

8
Driver Licenses ID Cards
  • Fraud Abuse
  • Apply for a license in more than one state
  • Use false breeder documents to obtain real
    license
  • Same identity
  • Different identity
  • Modify a real document
  • Create counterfeits
  • Bribe a DMV employee

9
Driver Licenses ID Cards
  • Fraud Abuse - Whats the harm?
  • Bad drivers are able to avoid control actions by
spreading convictions out over multiple licenses.
  • Our youth can all too easily obtain access to
    alcohol tobacco products.
  • Identity theft is facilitated
  • Terrorist activity is facilitated

10
Activities Prior to September 11
  • 1996 issued best practices for initial issuance
of drivers license or IDs (Uniform ID Practices
    Model Program).
  • 1996 petitioned Congress to pass legislation
mandating minimum standards for driver licenses.
  • 1999-2001 worked with Congress and NHTSA to study
the feasibility of establishing the Driver Record
    Information Verification System (DRIVerS)
  • 2001 established AAMVA best practices for the
information contained on the drivers license and
ID card document and the technologies used.

11
Executive Committee Resolution
  • October, 2001, Special Task Force Formed
  • Develop strategies to enhance the security
integrity of driver licenses and non-driver IDs
    issued by the DMV.
  • Scope U.S. Canada

12
AAMVAs Recommendations
  • Improve and standardize initial drivers license
    and ID card issuance process.
  • Standardize definition of residency in all states
    and provinces.
  • Establish uniform procedures for serving
    non-citizens.
  • Establish minimum standards to produce a secure
and interoperable drivers license/ID card that
    will uniquely identify an individual.

13
AAMVAs Recommendations
  • Establish methods for the prevention and
detection of fraud and for auditing of the
drivers license and ID issuance process.
  • Ensure greater enforcement priority and enhanced
    penalties for fraud.
  • Seek U.S. federal support and funding to assist
    nation-wide implementation by the states.
  • Encourage public and stakeholder awareness and
    support.

14
Management Plan
  • Define the problem
  • Seek support of Governors and state legislatures
  • Obtain Federal support and funding
  • Seek input from document users
  • Seek input from other government agencies
  • Seek input from industry on technology and
    security features

15
Obligatory Sports Analogy
  • Where are we in this effort?
  • If this project was a nine-inning baseball game,
wed be in the bottom of the 2nd inning.

16
Is AAMVA Creating THE National ID Card?
  • NO! There are several differences between these
documents and the national ID concept.
  • We have recognized that the drivers license is
used domestically as an identification document.
  • The DMV has the responsibility and obligation to
improve the credibility of the drivers license
    non-driver ID as secure documents.
  • One driver / one license / one driver control
    record

17
Intended Outcomes
  • Increased public and highway safety.
  • Eliminate the use of the driver license
non-driver ID in the commission of fraud.
  • Increased efficiency and effectiveness for law
    enforcement.
  • Continued reciprocity in North America.

18
IT Challenges
  • 1 - How will we uniquely identify an individual
in a population of 250 million?
  • We cant let a person get more than one card.
  • 2 - What security will be on the card?
  • How much is enough? Too much?
  • Need to link the person, card and record
  • 3 - How will we detect internal fraud?
  • Since other avenues are eliminated, internal
fraud will be easiest way to commit fraud.

19
IT Challenges
  • 4 - How will we protect ourselves from external
    threats?
  • Currently, this is not an issue. It will become
more of an issue since the driver record will be
a part of the overall security.
  • 5 - How will we verify breeder documents?
  • We are working with SSA, INS, NAPHSIS to
    electronically verify their documents
  • Canada and Mexico are connected to network
  • What can be done from a practical standpoint?

20
Policy Challenges
  • Will the driver license continue to be used as an
    identification document?
  • If not, we still need to secure the license
  • If so, who will be allowed to verify the
authenticity of the card? How will that be done?
  • What information obtained from the card can be
    retained by the private sector?

21
Policy Challenges
  • Who will have access to the information system
that identifies individuals that were issued a
    card by the DMV?
  • With respect to the breeder documents, how much
    verification is truly needed?

22
Privacy and DMV Records
  • Governed by the Federal Driver Privacy Protection
Act (DPPA) as well as state statute.
  • Need to strengthen with respect to any new
identifiers needed to secure the driver license.
  • Previously listed privacy issues will need to be
    addressed.
  • There is room to improve both privacy security.

23
Stakeholders
  • State Government
  • NGA, NCSL, CSG, NACIO
  • Federal Government
  • DOT, SSA, INS, IRS, DOJ, Homeland Security
  • GSA, USPS
  • Others
  • NAPHSIS, NRF

24
