Two Disability Programs
  • Social Security Disability Insurance (SSDI)
  • Title 2 of the Social Security Act

Social Security Disability Insurance -- SSDI
(Title II benefits)
  • Pays workers under age 65, who are disabled or
    blind and their dependents
  • Disabled Individual Beneficiary (DIB)
  • Childhood Disability Benefits (CDB)
  • Disabled Widow or Widower Benefits (DWB)
  • Worker must be insured, i.e., have paid into the
    Trust Fund
  • Eligible for Medicare after 24 months

Supplemental Security Income - SSI(Title XVI)
  • Pays people who are aged, blind or disabled
    including minor children with disabilities
  • Income and asset limits
  • No benefits paid to dependents
  • Benefits paid from general tax fund, not the
    Social Security Trust Fund
  • Eligible for Medicaid

Definition of Disability Adult Age 18
  • The inability to engage in any substantial
    gainful activity (SGA) by reason of any medically
    determinable physical or mental impairment(s)
  • which can be expected to result in death
  • or which has lasted or can be expected to last
    for a continuous period of not less than 12
    months.
  • (If individual received SSI before 18 will need
    to be re-evaluated to see if they meet adult
    criteria.)

Keep in mind.
  • It is possible to receive benefits under both
    programs (concurrent benefits)
  • An SSI recipient who works, may one day be
    insured for SSDI
  • An individual found disabled prior to age 22 at
    some time could be eligible for Childhood
    Disability Benefits (CDB) on a parents record
    (retired, disabled or deceased)

Substantial Gainful Activity (SGA)
  • Important part of the eligibility process
  • Used in determining initial disability (other
    than blindness) for both SSI and SSDI
  • 860 for 2006 (1450 if blind)
  • Claim is denied at initial application if current
    SGA is established
  • After SSI benefits start, SGA is not a
    consideration
  • Income is used only to determine SSI benefit
    amount
