Purpose

• To obtain approval of Parliament ito section 2(3)
  of the National Parks Act to exclude two
  properties from the Kalahari Gemsbok Park
• (a) Mier Erfenis Gronde (Administrative
  District of Mier, Northern Cape)
• (b) San Erfenis Gronde (Administrative District
  of Mier,Northern Cape)

Background

• Khomani San submitted a Land Claim in 1995 for an
  area more or less 500 000 hectares (included half
  the KGP and the northern area of the Mier rural
  land)
• Mier Transitional Council subsequently submitted
  a land claim in 1998 for 28 farms and another
  part of the national park

• Commission on Restitution of Land Rights
  negotiations
• Broad settlement agreement signed on 21 May 1999
• Ito Agreement
• (a) SANParks to transfer the area from the SW
  border to 10 km south of the Auob River to
  communities

• (b) Grant subject to
• 1) DoLA and communities reaching agreement
  on which land is to be transferred to
  communities
• 2) Parliament agreeing that portion being
  excluded from the national park and that it be
  proclaimed as a contractual park
• 3) Said land being utilised and managed by
  claimant authority ito an agreemeent settled
  with SANParks

• 4) Land not being utilised for mining,
  residential and/or agricultural purposes
• On restoration of the land communities agreed to
  have land incorporated into the KGNP

Vision

• Establish 2 distinctive and successful contract
  parks to benefit communities and in national
  interest
• Finally settle land claims of the community
  parties
• Establish positive, co-operative relationship
  between community parties and SANParks

• Conditions of title transfer of the land to the
  communities are addressed in the final agreement
