The Issue
To reach an Industry-wide, definitive position
for the aforementioned products with regard to
the WEEE Directive
  • The Conclusion
  • Following extensive consultation with interested
    parties
  • Referring to all DTI published Guidance Notes
  • These products are outside the scope of this
    Directive.

5
The Basis for Exclusion
  • DTI WEEE Guidance Notes - Other product types
which are deemed to be outside the scope of the
    Regulations
  • Paragraph 18 from page 8 of the DTI WEEED
    Guidance Notes SI 2004
  • Equipment which is part of a system and has
    no other function
  • Paragraph 19 from page 8 of the DTI WEEED
    Guidance Notes SI 2004
  • Part of a fixed installation, professionally
installed to perform a specific task
  • Extract from the WEEED Guidance Notes

6
Typical System Installations(For Product Groups
shown on page 3)
  • Part Of A System, Fixed Installation,
    Professionally Installed (Part P)

7
Installation requirements
  • All products require professional installation
  • Hard wiring to a fused spur or dedicated circuit
  • Fixed plumbing connection to the local system

It is dangerous to de-install the products for
exchange when replacing
8
Initial DTI Meeting - June 16th 2005
Present DTI, AMDEA BEAMA TEHVA Representatives
  • Conclusions
  • Most Product Positions Defined - In or Out of
    scope of the Directive
  • Products Out of scope - Electronic
    Showers
  • - Electric Flow Boilers
    - Direct Water Heaters (Large Small)
  • - Indirect Water Heaters
  • - Circulating Pumps
  • The arguments that electric showers and under
sink water heating were out of scope were seen to
    have merit
  • NB - Central Heating Systems and Boilers were
    exempted at other meetings

9
2nd Meeting with DTI - September 14th 2005
  • Present DTI, AMDEA BEAMA TEHVA
    Representatives
  • Presentation given relating to electric showers
    and under sink water heaters
  • Products are part of and are tailored to,
    particular water and electrical systems
  • They have no other use and are part of a fixed
    installation
  • They are required to be installed by competent
    persons
  • Part P regulations apply to installers
  • It is dangerous to de-install the products for
    exchange when replacing
  • DTI Conclusions
  • The presentation provided a good rationale for
    exclusion
  • The position of every product could not be
    detailed
  • The basis for whether products were in or out of
scope should be Annex B of the Guidance Notes -
    ie A Decision Tree

10
The WEEED Guidance Notes Decision Tree
Part of another type of equipment or
fixed installation? If Yes - then Not
covered
11
The Industry Position
  • It is important that Producers and Customers have
a clear understanding of their position and that
    a common approach is adopted.
  • The industry has analysed the Guidance Notes to
the Directive and consulted extensively with DTI
  • The installation of our products is defined by
Paragraphs 18 and 19 of the Notes and confirmed
    by Annex B
  • We conclude therefore that our products are part
of a fixed installation within a wider system,
must be installed by competent persons and are
therefore outside the scope of the Directive
