  • The Legal Position
  • CENELEC takes precedence within the European
    Union National
  • Committees (BSi) must publish CENELEC version and
    withdraw any
  • conflicting existing national standard.
  • Only BS EN50083 part 1 (Safety) and part 2
    (electromagnetic
  • compatibility) are MANDATORY under the EU Low
    Voltage and EMC
  • Directives.
  • Other Standards are for guidance, good practice,
    freedom of trade
  • and for use as specifications in contractual
    documents.

  • So whats in the pipeline?
  • With exception of EN50083-8 (system EMC),
    standards development and maintenance work is
    being transferred to IEC (IEC 60728) under
    Technical Committee 100 (TC100),Technical Area 5
    (TA5).
  • In addition to general maintenance the increased
    scope of 60728 (balanced cables and extending to
    CPE) has meant that most of the Standards need to
    be re-evaluated.
  • Part 8, system EMC is considered to be too
    specific to the European member governments
    requirements to transfer to IEC at present.

  • The New EMC Directive Why bother
  • Better Clarity
  • Distinction between apparatus and fixed
    installations, accurate definitions of
    components and sub-assemblies, specific
    exclusions e.g. aeronautical RTTE
  • Less Burden on Manufacturers
  • No mandatory independent assessment body
    required whether using Harmonised or not
  • Better Enforcement
  • Identification of manufacturer (or person
    responsible for placing on the market if not of
    EU origin)

  • The New EMC Directive Timetable
  • Entry into force 20/01/2005
  • All national provisions incompatible with the
    act become inapplicable
  • Deadline for transposition 20/1/2007
  • Transposition must be performed, 89/336/EEC
    still into force, new directive cannot be applied
    even if transposed
  • Date of application 20/07/2007
  • Pivot date, 89/336/EEC is repealed, new
    directive can be applied from that date
  • End of transitional period 20/07/2009
  • New directive is of mandatory application,
    apparatus compliant with 89/336/EEC cannot be put
    on the market anymore

  • Essential requirements
  • Equipment shall be so designed and manufactured,
    having regard to the state of the art, as to
    ensure that
  • The electromagnetic disturbance generated does
    not exceed the level above which radio and
    telecommunications equipment or other equipment
    cannot operate as intended
  • It has a level of immunity to the
    electromagnetic disturbance to be expected in its
    intended use which allows it to operate without
    unacceptable degradation of its intended use.

  • An EMC assessment must be performed, on the
    basis of relevant phenomena, to ensure that the
    protection requirements are met by either
  • Use of harmonised standards
  • Using other methods
  • Or a combination of these

  • Use of Harmonized Standards
  • A harmonised standard can be a Mandate from the
    Commission or a standard prepared by a
    recognised European standardisation body
    (CEN,CENELEC or ETSI) and published as European
    Standard
  • Note When referenced in the Official Journal
    of the European Union it gives presumption of
    conformity
  • The correct application of all the relevant
    harmonised standards is equivalent to making an
    EMC assessment

  • Use of other methods
  • A thorough investigation of which EMC phenomena
    are relevant to the apparatus must be done
    including the intended use and location of use
  • Acceptable limits must be established for
    compliance for the applicable phenomena
  • Compliance must be established by tests,
    simulations, calculations

  • Specific requirements for fixed installations
  • Installation and intended use of components
  • A fixed installation shall be installed applying
    good engineering practices and respecting the
    information on the intended use of its
    components, with a view to meeting the protection
    requirements as set out.
  • Those good engineering practices shall be
    documented and the documentation shall be held by
    the person(s) responsible at the disposal of the
    relevant national authorities for inspection
    purposes for as long as the fixed installation is
    in operation.
