Noise Ordinance Overview
  • The new Ordinance, passed with amendments,
    clarifies the regulation and enforcement of noise
    in the City and regulates sources of noise
    through a prohibitive approach, similar to the
    existing Fulton County Noise Ordinance.
  • It includes the following
  • Construction may take place from 730 a.m. -730
    p.m. Monday through Friday and 8 a.m. 5 p.m. on
    Saturday and no construction on Sundays and
    holidays.
  • Landscape Contractors may work 730 a.m. -730
    p.m. Monday through Friday and 8 a.m. 5 p.m. on
    Saturday and no work on Sundays and holidays. The
    exemption is that individual homeowners may work
    on their property for extended weekday and
    weekend hours, as well as on Sundays and
    holidays.
  • Radios may be played until 11 p.m. on weeknights
    and until midnight (1200 a.m.) on weekends and
    holidays with sound audible to the property line.

Tree Ordinance Overview
  • Uses Tree Canopy approach to retain and reclaim
    canopy
  • Defines
  • Landmark Trees as hardwoods 27 Diameter Breast
    Height (dbh) or greater, Pines 30 dbh or
    greater, Dogwoods and Redbuds 10 dbh or greater.
  • Buffer Tree as any tree 18 dbh or larger located
    in the minimum required yards/setbacks of any
    property.
  • Protected Tree as any tree 18 dbh or larger.
  • Boundary Trees as an overhanging tree on adjacent
    property
  • Requires a Tree Removal permit
  • To remove a Landmark Tree
  • To impact a Boundary tree
  • To remove a Protected tree
  • Provides incentives for protecting more that
    minimum canopy
  • Provides Administrative Standards Best
    Practices

Tree Canopy
  • Requires 30-40 retention of tree canopy
  • Residential 30 of lot area
  • Non residential Other 40 of lot area
  • Commercial 40 of lot area
  • Industrial 40 of lot area
  • Requires maximum replanting on site to obtain
    canopy coverage
  • Then, any unmet canopy requirement mitigated by
    contributing to Tree Bank

Tree Removal Permits
  • The Tree Ordinance applies to all owners of real
    property in SS and closes the prior single
    Family Loop hole that allowed clear cutting
  • Required if
  • Landmark Trees removed
  • Boundary Trees are impacted
  • Buffer Trees are removed
  • Protected Tree are removed 
  • Photographs and drawings of the location of all
    the trees on the site and approximate diameter
    and species
  • Public Notification of Landmark Trees Being
    removed  
  • Only owners who are adjacent to the property upon
    which a Landmark Tree is proposed to be removed,
    will be given written notice and can appeal the
    removal within 30 days of notice
  • Trees not protected hazardous trees and trees
    less than 18 diameter

Site/Tree Conservation Plan (STCP)
  • Required with any residential or commercial
    permit
  • A pre-requisite for Tree Removal permit
  • Must accurately map all existing trees
  • Must identify trees to be removed
  • Must show all construction and land disturbance
    activities/areas
  • Must meet canopy requirement

Sandy Springs Tree Bank
  • When City Arborist deems it impractical or
    impossible to meet canopy requirements on site,
    Tree Bank accepts payments for unmet canopy
    requirements.
  • Tree Bank administered, pursuant to City Council
    policy and program, by Director of Community
    Development.
  • Funds solely used to increase/maintain tree
    canopy in public spaces.

Enforcement Appeals
  • Enforcement assigned to Department of Community
    Development.
  • Administrative appeals to the Board of Zoning
    Appeals
  • Subsequent Judicial appeals to Fulton County
    Superior Court by writ of certiorari
