What Determines Liability?
  • Four point test

1. Duty of ordinary care
  • Foreseeable
  • Known or should have known

  • Doing something you shouldnt have
  • Not doing something you should have

  • To the individual
  • To property

  • Natural and continuous sequence of events with

    policies/procedures, team and student
    handbook(s), Predict and preventforeseeable

  • Plan ahead-foreseeable circumstances
