2Introduction
- Civil Rights Regulations are intended to assure
that benefits of CACFP are made available to all
eligible persons in a non-discriminatory manner - All sponsors receiving Federal must implement
Civil Rights requirements to be eligible for all
Child Nutrition Programs - Food and Nutrition Service (FNS) instruction 113
is the federal regulation governing Civil Rights
in the Child Nutrition Programs
3 Discrimination is
The 3 Ds
- when an individual or group of
individuals are - Denied benefits or services that others receive
- Delayed receiving benefits or services that
others receive, or - Treated Differently than others to their
disadvantage

SDE provides census data by county to you to meet
this requirement. This will need to be updated
with the 2010 census numbers when they are
available. Report as a PERCENTAGE.

- News Media NotificationAnnually submit a public
release to the local news media describing your
specific program. - Minority and Grass Roots OrganizationsAll CACFP
institutions are required to contact minority and
grassroots organizations to recruit potential
participants.

- Benefits and services
- Procedures for filing a complaint, in English
and/or in the appropriate translation to
non-English speaking persons. - If needed use alternative means of communication
(Braille, large print, audiotape, etc.).
11Procedures for Filing a Complaint
1. Right To File A Complaint Any person
alleging discrimination based on race, color,
national origin, sex, age, or disability has a
right to file a complaint within 180 days of the
alleged discriminatory action. Under special
circumstances this time limit may be extended by
the Office of Civil Rights (OCR).
12Procedures for Filing a Complaint
2. Acceptance All civil rights complaints,
written or verbal, shall be accepted and
forwarded to the state agency to be forwarded to
the Civil Rights Division at WRO. It is
necessary that the information be sufficient to
determine the identity of the agency or
individual towards which the complaint is
directed, and to indicate the possibility of a
violation. Anonymous complaints should be
handled as any other complaints.
13Procedures for Filing a Complaint
3. Verbal Complaints In the event a
complainant makes the allegations verbally or
through a telephone conversation and refuses or
is not inclined to place such allegations in
writing, the person to whom the allegations are
made shall write up the elements of the complaint
for the complainant. Every effort should be made
to have the complainant provide the following
information.
14Components of Verbal Complaints
- Contact information for the complainant.
- The specific location and name of the entity
delivering the service or benefit. - The nature of the incident or action that led the
complainant to feel discrimination was a factor. - The basis on which the complainant feels
discrimination exists (race, color, national
origin, sex,age, or disability). - The names, titles, and business addresses of
persons who may have knowledge of the
discriminatory action. - The date(s) during which the alleged
discriminatory actions occurred or, if
continuing, the duration of such actions.

- If a complainant returns a complaint form or
provides a verbal complaint the sponsor must
forward the complaint to the State Agency within
three working days.

- CR Complaint Form must be readily available at
all sites - Sponsor must make every attempt to help
complainant complete CR Complaint Form - If complainant returns CR Complaint Form to
sponsor, it must be forwarded to SDE with in 3
working days of receipt by sponsor

- All discrimination complaints must be documented
in the Civil Rights complaint log -
- Log must be dated with Year and kept for 3 years
current FY, even if no complaints have been
received

- All staff involved in CACFP must receive annual

- In accordance with Federal law and U.S.
Department of Agriculture (USDA) policy, this
institution is prohibited from discriminating on
the basis of race, color, national origin, sex,

- The full statement is the preferred statement on
all documents anytime the USDA food programs are
referred to in brochures, bulletins, leaflets,
letters, etc. - The full statement must be used in documents that
are more than 1 ½ pages - All statements should be in print size no smaller
than the text of the document

mentioning USDA or the CACFP if document is 1 ½
page or less in length. - This institution is an

when asked and /or are not able to verbalize the
civil rights complaint procedure to reviewer
