Committee Process
  • Consideration of the comments from the hearings
    in October, 2004. First reading held October 18,
    2004.

    from Dr. Petillo.
  • Meeting held with NJDS faculty concerning
    specific issues of interest.
  • Meeting with NJMS Chairs concerning composition
    of the Executive Council.

Article I-Construction and Application
  • I.A.1 Specific language from the University
    Bylaws has been inserted
  • I.A.2 The Academic Assembly, as defined in these
    bylaws, now is included among those who are
    consulted concerning revisions to the bylaws.

Article II-Administrative Structure
  • II.A.1.3 The Deans Search Committee shall be
    chosen from a list of individuals nominated by
    the elected officers of the Academic Assembly and
    the elected part time representative of the
    Sub-Committee on Committees, and endorsed by the
    Academic Assembly.

  • II.A.1.4 The Academic Assembly will vote on the
    slate of nominees for Dean as provided by the
    Deans Search Committee.
  • This differs from our current process in which
    the faculty vote occurs subsequent to the
    President selecting the Dean.
  • This vote is for a slate and not each nominee
    individually.

  • The result of the vote for the slate of nominees
    is then submitted to the President prior to
    his/her announcing the selectee.
  • II.A.1.4 A vote of 67 will constitute an
    endorsement of the slate.

  • IIA.1.5 Any candidate nominated for Acting or
    Interim Dean shall be vetted by the Academic
    Assembly. A 67 approval shall constitute an
    endorsement of the nominee. The results of the
    ballot shall be transmitted to the President.

  • II.A.1.7 The review of the stewardship of the
    Dean shall be conducted by the Senior Vice
    President for Academic affairs, who shall appoint
    a committee which shall be composed of at least
    50 NJDS faculty.
  • II.A.1.8 The stewardship of the Acting or
    Interim Dean shall be reviewed by the Executive
    Council at least every two years.

  • II.A.1.7 In order to eliminate a duplicitous
    process, the Executive Council will no longer be
    conducting an independent evaluation of the
    stewardship of the Dean. However, if the
    University review is delayed in a manner that is
    unsatisfactory with the Academic Assembly, the
    Assembly may request that the Council conduct
    such review.

  • II.B.1.6 The department chairs shall be subject
    to review and evaluation at least once every five
    years , following procedures in the NJDS
    Procedural Code. This also applies to division,
    section or program heads.

Article III-Organization of the Faculty
  • III.A.1 The Faculty is defined as those
    individuals who hold academic titles in
    UMDNJ/NJDS. The Dean shall be the presiding
    officer of the Faculty.
  • III.B.2.1 The Academic Assembly is composed of
    faculty, Administration, and Alumni
    representation. The President of the Academic
    Assembly is the presiding officer of the
    Assembly.
  • III.B.3.4 The office of Secretary-Treasurer of
    the Assembly has been created.

  • III.A.3 Communication with the Universitys
    Administration. This section has been inserted
    from the University Bylaws and states that, even
    though communication between the faculty and
    University Administration ordinarily occurs
    through the Dean, when appropriate or necessary,
    the faculty may communicate directly to the
    President or Senior Vice Presidents.

  • III.B.1.4 The Assembly may express concerns
    directly to the Dean and may advise the Dean on
    matters affecting the operation and policies of
    the school.

  • III.C.1.1 The Executive Council is a standing
    committee of the Assembly.
  • III.B.1.5 The rights of the Assembly to review
    and to accept or reject decisions of the
    Executive Council shall not be abridged.
  • III.D.2.2 The Dean shall be the chair of the
    Executive Council.
  • II.D.2.2 The President or Vice President of the
    Assembly shall serve as chair of the Executive
    Council in the Deans absence.

  • III.D.2.1 Voting membership in the Executive
    Council changed to reflect parity in
    administrative and non administrative membership
  • Both the President and the Vice President of the
    Academic Assembly are voting members.

  • Eight at large elected faculty representatives
  • Four full time NJDS faculty
  • Two part time NJDS faculty
  • One basic science NJDS faculty
  • One basic science NJMS faculty
  • NJMS Chairs are non voting members

  • III.C.1.2 The Community Advisory Committee is
    listed as a standing committee of the Assembly.

Article IV- Faculty Appointments and Non Renewals
  • Vast majority of the language from the UMDNJ
    Bylaws.
  • Criteria for AP Committee recently approved by
    Executive Council and incorporated in NJDS
    Procedural Code.
  • IV.C.9.1 New language concerning appeal process.
    Chair of AP Committee will forward to the
    candidate a written report of negative vote
    results through the department chair. Appeals
    must by made within 10 days of notification.

  • IV.C.9.1 Appeals will only be allowed based upon
    alleged procedural error by the AP Committee, or
    alleged failure of the AP Committee to base its
    decisions solely on the standards as defined in
    the NJDS Procedural Code and on other appropriate
    considerations.

Article V-Faculty Renewal Program
  • The NJDS Faculty Affairs Committee will, along
    with the Dean and the department chair, make
    recommendations to the Senior Vice President for
    Academic Affairs concerning approval for the
    faculty renewal program.

Article VI-Termination of Service
  • This is a new article completely based upon the
    UMDNJ Bylaws

Article VII- Grievance Procedure
  • No changes have been proposed.

Article VIII-Amendments
  • VIII.A.2.1 Regarding amendments to the bylaws
    proposed by the Board of Trustees The Assembly
    would now have 60 days, instead of 45 days, to
    present its views to the BOT.

Ratification Process
  • Ballots will be mailed on Monday, April 4, 2005
    and must be received by Friday, April 22, 2005,
    500 PM.
  • Ballots will be counted on Monday, April 25,
    2005.
  • A 2/3 approval vote for each article is required
    for ratification.
