5MOE ELIGIBILITY DETERMINATION PROCESS
- Application is initiated at Assessment stage and
completed at Case stage. - If the household is determined to be eligible for
MOE, the MOE start date must be added on the
Trails Entitlement screen. - The MOE start date can be no earlier than the
Date of Application on the MOE eligibility
form, and, No earlier than the Without Regard to
Income (WRI) in the Entitlement Screen in
Trails. - The county worker also must enter the MOE
information into CBMS (Colorado Benefits
Management System).

7BASIC ELIGIBILITY CRITERIA
- An emergency exists, defined as the child is at
risk of removal from their home into publicly
funded care or supervision. - The household income is less than 75,000 per
year. - The child lives with a parent(s) or other
specified relative.
8Income Criteria Verification
- The household income is less than 75,000 per
year. - All forms of income are included Work related
and entitlements such as SSI and Social Security. - Sources of verification include TANF/WORKS, Food
Stamps, Department of Labor and Employment, LEAP,
SVES - State Verification and Exchange System,
Federal Entitlements such as SSI, SSA, etc.
9 ADDITIONAL ELIGIBILITY FACTORS
- The child (for which an emergency exists) Must
be a U.S citizen or qualified alien (See Volume
III 3.140.1 CITIZENSHIP AND ALIEN STATUS). - The family must be residents of Colorado.
- The need for services or assistance must not be
the result of a family members refusal without
good cause to accept employment or training for
employment.
10REQUIREMENTS FOR CLAIMING EXPENDITURES AS TANF MOE
- State expenditures count as MOE only if made to
or on behalf of families that - Have a child living with a parent or other adult
relative and - Are needy under the TANF income standards
established by the State under its TANF plan (The
family gross annual income must be less than
75,000).
11TANF MOE APPLICATION
- Counties are required to complete the TANF MOE
Certification for Emergency Assistance form on
all MOE eligible households. - The household can only be authorized for MOE once
in a 12 month period. At the end of those 12
months, a redetermination of eligibility must be
made.
12TANF MOE REDETERMINATIONS
- The household can only be authorized for MOE
once in a 12-month period. - At the end of those 12 months (if the case is
still open in Trails) a redetermination of
eligibility must be made. - To determine if the household remains eligible
for TANF MOE, the Certification of Emergency
Assistance Redetermination Form should be
completed.
13Concurrent Eligibility
- The child can be concurrently eligible for MOE,
IV-E, and SSI if the eligibility criteria is met
for all three funding streams. - A child placed in foster care with a relative can
meet the MOE and IV-E criteria. - If the child is disabled the SSI criteria may
also be met.
