Harbour Protection Ordinance
Enacted in June 1997. Amended in November 1999
to make it apply to the entire area of the
Victoria Harbour.
"The harbour is to be protected and preserved as
a special public asset and a natural heritage of
Hong Kong people, and for that purpose there
shall be a presumption against reclamation in the
harbour."
The Government established the Harbour
Enhancement Committee in May 2004.

Harbour-front Enhancement Committee (HEC) Terms
of Reference
To advise the Government through the Secretary
for Development on planning, land uses and
developments along the existing and new
harbour-front of the Victoria Harbour, with a
view to protecting the Harbour improving the
accessibility, utilization and vibrancy of the
harbour-front areas and safeguarding public
enjoyment of the Harbour through a balanced,
effective and public participation approach, in
line with the Harbour Planning Principles (HPPs)
and Harbour Planning Guidelines (HPGs).
Specifically, the Committee will (a)
Provide input to the Urban Design Study for the
New Central Harbourfront
(b) Advise on the planning, design and
development issues including land use, transport
and infrastructure, landscape and other matters
relating to the existing and new harbour-front
and the adjoining areas
(c) Advise on means to enlist greater public
involvement in the planning and design of the
harbour-front areas and
(d) Explore a framework for the sustainable
management of the harbour-front in line with the
HPPs and HPGs, including public-private
partnership.

Review of the 2002 Plan Kai Tak Planning Review
25 June 2002 - the statutory plans for Kai Tak
were approved.
9 January 2004 - the Court of Final Appeal on
Harbour Protection Ordinance - presumption
against reclamation in the Harbour Area can only
be rebutted by meeting the overriding public
need test.
Since the approved Kai Tak statutory plans would
involve 133 hectares of reclamation, a
comprehensive review of the statutory plans was
required to ensure compliance with the legal
requirement.

  • The HEC Sub-committee considered the conventional
    Summary of Responses of Comments insufficient in
    meeting the publics aspiration for a more
    transparent process as to how the public
    comments/proposals were being analyzed and
    concluded.

 
  • To enhance the transparency of the process and
    foster building greater public consensus, the
    Sub-committee considered that members of the
    public should be involved again to examine the
    public comments and proposals received before
    concluding the public participation report and
    the preparation of the Outline Concept Plan
    options for the next stage of public
    participation.

Collaborators Meeting
The HEC Sub-committee advised to convene a
Collaborators Meeting to discuss the approach in
the preparation of the Outline Concept Plan (OCP)
for Stage 2 Public Participation. The main
purpose of the meeting is to discuss the
technical issues involved in preparing the OCPs
and to gather suggestions for Stage 2 Public
Participation. The meeting was held on 4 June
2005 A number of organizations representing
different sectors of the public, including the
District Councils, green groups, academic and
professional bodies and the Sub-committee members
are invited to join this meeting.

Town Planning Board.

On 12 January 2006, the HEC Sub-committee was
briefed the results of Stage 2 engagement. The
HEC Sub-committee decided to arrange a public
forum to facilitate public discussion on the
comments/proposals received in the Stage 2 Public
Participation and the responses of Government
bureau/department and the Consultants as well as
to involve the public to discuss the initial
ideas of the Study Consultants in the preparation
of the Preliminary Outline Development Plan.

- A useful platform for the general public and
the stakeholder groups to maintain dialogues.
- A genuine blank-sheet approach (no population
target, no fixed vision).
- Allows the Government to communicate with the
public about the development components (stadium,
cruise terminal, etc.)
- Allows the Government to truly understand the
feelings of the public, e.g., towards the
importance of integration with the surrounding
area.
- Reduces the chances of having to go back to
drawing board again in statutory and legal
process.
- A model for other public engagement process.
