Criminal JusticeBaseline Quiz
1. How many degrees of murder exist under
Georgia law?
Georgia recognizes only murder (O.C.G.A.
16-5-1(a)), and does not have various degrees of
murder as other states may have. Georgia does
have levels of homicide below murder, including
Voluntary Manslaughter (O.C.G.A. 16-5-2) and
Involuntary Manslaughter (O.C.G.A. 16-5-3).
Georgia also recognizes Felony Murder, when the
death occurs during the commission of a felony
(O.C.G.A. 16-5-1(c)), Vehicular Homicide
(O.C.G.A. 40-6-393) and Feticide (O.C.G.A.

7. How many federal Judicial Circuits cover the
United States?
There are a total of thirteen federal appellate
courts below the United States Supreme Court.
The 94 U.S. judicial districts are organized into
12 regional circuits, each of which has a United
States Court of Appeals. Eleven of the regional
circuits are numbered, while the twelfth is the
District of Columbia Circuit. A Court of Appeals
hears appeals from the District Courts located
within its circuit, as well as appeals from
decisions of federal administrative agencies. In
addition, the Court of Appeals for the Federal
Circuit has nationwide jurisdiction to hear
appeals in specialized cases, such as those
involving patent laws and cases decided by the
Court of International Trade and the Court of
Federal Claims.

14. What is the exclusionary rule?
Exclusion of evidence as a remedy for Fourth
Amendment violations found its beginning in Boyd
v. United States, 116 U.S. 616 (1886). As an
aside, Boyd involved not a search and seizure but
a compulsory production of business papers which
the Court likened to a search and seizure. The
first criminal case to apply the exclusionary
rule was Weeks v. United States, 232 U.S. 383
(1914). But see Hudson v. Michigan, 547 U.S. ___
(2006).

Be brief. Short questions, plain words. Nothing
but leading questions. Never ask a question to
which you don't already know the answer. Listen
to the answer. Don't quarrel with the
witness. Never permit the witness to
explain. Don't give the witness an opportunity to
repeat his story. Avoid the one question too
