What is EAD ?
  • Employment Authorization Document (EAD) is the
    work permit is granted by USCIS which give the
    holder of it the legal right to work in the USA.
  • The rights it possess and grants are similar to
    the green card but having minor variation. The
    work limit generally is given for maximum one
    year.
  • Every candidates EAD has the expiry date
    mentioned on it. Thus Employment Letter for
    OPT/EAD candidates is necessary to start out the
    work.
  • Employment authorization document or EAD Card,
    allows all eligible visa categories, to legally
    work in USA whether it is F1OPT jobs, H1B , H4,
    L1, L2, J1, J2,etc.

How do I apply for F-1 OPT ?
  • Once you receive a recommendation for
    post-completion OPT from your Designated School
    Official (DSO) to pursue OPT, you must apply for
    an employment authorization document (EAD) with
    USCIS within 30 days. Additionally, you may file
    up to 90 days prior to your program end-date and
    not later than 60 days after your program end
    date.

  • Note Do not start working until you receive
    your employment authorization document (EAD) in
    USA.  Performing work without an EAD can
    negatively affect your immigration status now and
    in the future.

EAD Application Process
  • File EAD Application.
  • EAD application can also be filed electronically
    online at USCIS website and get specific
    instructions on e-filing application for
    employment authorization.
  • For applying EAD you need to fill Form no. I-765,
    or you can e-file for EAD but H4 candidates are
    not eligible to e-file for EAD.
  • Mail a paper application at the filing
    address associated with the corresponding
    eligibility category.
  • Which ever method you use to apply for EAD you
    check the payment fees and the filing locations
    for Form I-765 for a list of mailing addresses at
    https//www.uscis.gov/i-765
  • Pay EAD Fees.
  • If you e-file your EAD application, you must pay
    the fee by credit card, debit card, or electronic
    transfer of funds from a checking or savings
    account from a US bank.
  • If you mail your application, pay the fee by
    check or money order.

EAD Requirements for F1 Students
  • Passport
  • Visa
  • Current I-94
  • non-immigrant visitors arriving at a seaport or
    airport will not receive a paper I-94. They must
    print their I-94 and bring the printed form for
    verification
  • Non-immigrant visitors arriving at a land border
    port of entry will still receive the paper I-94
    stapled into their visa
  • Current I-20 or DS-2019 (issued by USCIS)
  • J-1 Students must also show a Letter of
    Authorization to work issued by the International
    Scholar and Student Services (ISSS) Office.

    visa qualify for Curricular Practical Training
    (CPT) during the summer internship period and
    there are number of cpt jobs in USA . J-1 visa
    holders can also obtain authorization called
    Academic Training (AT).

    work in the US after graduation?
  • Yes, F-1 students have full US work authorization
    as part of OPT Job requirement for up to 12
    months post-completion of the degree program. J-1
    students have full US work authorization for up
    to 18 months as part of Academic Training (AT)
    work authorization. Employment must be directly
    related to the students major area of study.
  • Are international students eligible for long-term
    US employment?
  • After a students OPT or AT duration, a different
    type of work visa is required. The common
    temporary working visa, the H-1B, can be obtained
    initially for three years and extended once for a
    combined total of six years. The H-1B visa is
    only one option and to work for h1b jobs in USA.
